With any environment where there is a mechanism for people to put up videos, inevitably you will have a few who do so with content that doesn't belong to them. The IMPORTANT thing is that the site removes it as soon as possible, would that not be the same with hosted gallery content etc? If they were leaving it up saying fuck you, maybe, but they are actively working to REMOVE that content. In fact, it looks like they're asking for people to help by reporting it for removal. Wow, sounds so fishy (NOT!)

Technically (correct me if I am wrong lawyers o gfy) by them removing that content sans dmca, and if it was truly user submitted would constitute them moderating the content, therefore bypassing them from the 2257 loophole on user submitted content.

Think someone REALLY needs to layout why tube sites are allowed to operate without documents. Lot of confusion about it without question.

Well it's certainly one of those grey areas that happens in adult and on the internet when a new medium of communication is opened... takes a while for the dust to settle and a protocol to be established. Sure does throw back to the early days of TGP when everyone screamed about them being hotbeds for stolen content and it was up to the people who ran the sites to figure out how to deal with the mess.

As you can see Lebanon Part 2, which is a 57 min DVD rip was added 175 fucking days ago! I'm really touched by how much they were working to remove stolen content until they were caught on the forums. I want to cry.

Yes just bothers me when people start screaming for to take content down when they are not the copyright holder. Tube sites have to either be user submitted and content is only removed after dmca notice, or Owner submitted only. Owner submitted would be responsible to have 2257 docs on file. Can't have a blend of both and still stay on the legal side of 2257 from what I understand. With certain exceptions of course being content that is illegal period such as cp and beast etc. the owner could of course remove that.

The way to stop things such as that would be to have a filter or file size limit for uploads. Filter that only allows say a max of 10 minute clip to be uploaded.

Isnt it possible that whoever made a tube site, allowed user uploads. People uploaded stolen content, they saw this thread and removed said stolen content.

You guys should take your complaints to the government instead of gfy all day, you could run a tube with 10 billion stolen videos so long as they are removed on request there is nothing illegal people overreact to much.

gaytube is a 100% legal site. all content is user submitted. gaytube is run the way youtube is. all dmca requests are handled immediately. our user agreement has a prohibition against copyright infringement. everything is done the same way youtube does. in the 4 months the site has been open i've received only 4 dmca emails. i handled them immediately. there is nothing illegal about gaytube.

Gaytube is not illegal, just lots of the content was. That is just semantics.

that is incorrect. I now screen all incoming videos. this screening process started about two weeks ago. if a video looks like a potential copyright violation I contact the user that submitted it and request more info. the first 4 months were spent working on the script. all efforts were spent trying to keep the script from crashing. it took time but we finally stabilized it and integrated a sponsor tool which is doing very well. gaytube is converting at 1:140 with gaygravy and our overall average is 1:350 to all sponsors.

there are many companies that upload their own videos just for the exposure via the watermark. i am working on a tool where these companies can upload to a special area.

Who decides whats ok? For most of us the law, and the law says running a tube with 10 billion stolen videos that are user uploaded is OK so long as you remove on request.

And tons of toxic chemicals have been being pumped into the sea for a long time, which is why its recommended not to eat to much fish. So i guess it is ok correct.
