lightspeedcheerleaders.com

the second this was registered, you were knowingly infringing on the lightspeeds trademark

what do you have to say to that?

I am 100% in favor of going after trademarks. For any business it makes sense if you are running a business and don't trademark your property you will lose it, that happened to ddgirls.com Stephen Hicks didn't have the trademark and someone took his pay site that he had been running on that domain for years, he had to swap to digitaldesire.com, if he had trademarked it he wouldn't have had that problem.

Mike, just shut the fuck up.

No one is going to take any of your posts seriously because youre being paid to suck Shaps dick.

He's registering names that contain trademarks belonging to other people, other sites typos, etc... The exact same thing you're railing against in your posts on this topic can be applied to Shap then.

In 1987, as a result of an infringement suit by Radio Shack, Auto Shack changed its name to AutoZone.

Of course that is what they did. It really pisses me off to see large companies bully little guys like this. What they are doing is abusing the system. Comparing this to Pepsi protecting their TM is absurd.

Then sue them for copyright infringement. It's not like this is the only guy that's been threatened either, shap just said several sites got the letter.

Btw it was so weak to use the stolen content card :P I suggest you to change your lawyer to a better one, like mine :pimp

youtube: Registration Date October 28, 2008
sextube: Registration Date December 11, 2007

damn... this SHAP must be doing like 100k per month to have those protections..

but I think he needs to get a new lawyer, because his lawyer is totally wrong and has obsolete law knowledge. Shap, u need to keep up with new rules..

the days when you sat to play poker while sales came in, are long go...

Did you not use (and still do) heavily advertise on biggest tube sites, filled to the brim with stolen content? Should we pull the threads maybe?

Pot, kettle, and so on.

Doesn't matter as the TM is sextube and not the word tube. So NO he can not sue youtube.

I can see anyone questioning the steps being taken but I can clearly understand what it is to protect a brand. THe thing is that the TM is rather vague I would say as in 2 general words. Thats the problem, but hey Shap if your lawyer says you can get it than I wouldn't care less.

It is a business we are in, why would you have sympathy for someone else really? I mean we are here in the first place to make yourself money not? If Shap would like to make friends and cuddle he would probably do so elsewhere. Don't get me wrong as much as I dislike some of the steps being taken I can perfectly see what is going on, and sometimes you just have to drop the being Mr nice Guy attitude I guess.

Someone has a much more successful tube site than you so instead of trying to compete fairly you just send your lawyers after the domain so you can just divert the traffic to your site...

BradM 03-02-2009 02:04 PM

Shap do you sell ads on your tubes? Not fucking around - I buy ads on tubes and profit greatly. Pornhub, keez, snizz, etc etc. Please let me know pricing.

You can sue someone for anything and send those letters out so of course his lawyer is saying it's ok to do.

There's nothing wrong with speaking out when you think someone else is getting fucked over or in this case I guess it would be a group of people.

cykoe6 03-02-2009 02:10 PM

Personally I believe that this is bullshit but then that is the nature of business. If you can afford the legal costs then you can push people around. All part of the game.

Ofcourse you can sue for anything but can you also win anything at all without a case? Lets see how this works out as I doubt Shap is just wasting a pile of cash on lawyers ;))

And I agree nothing wrong with speaking out, just like I just did I guess!

Its not intimidating letters its intent of legal proceedings Shap owns the trademark and he is actively pursuing anyone who is in violation of that.

Sands 03-02-2009 02:19 PM

TNAFlix.com has a ton of stolen content, and probably a ton of traffic along with it. You'd have to be pretty comfortable with copyright infringement of other content owners to advertise there.

Lots of lawyers will give bad advice. Maybe his lawyer is just telling him to do it but has no real plans on suing or just doesn't care because it's not his money. And threatening to sue can make people cave in to your demands, a lot of people do it just for that reason.

I say it again - If you go to a registrar and they sell you an available domain, then it's yours incontrovertibly. The big guys can then suck it up and pay the new owner for it if they want it so bad.

That's a stupid comment, especially coming from a host. Trademark is trademark.

Love the expired adult domains in your sig, and we have held domains for girls and companies if they ask for them most times we hand them over, or redirect to their sites on request. If you are in the domain business I am sure you have done this from time to time, and we own more domains than the ones listed.

Sorry, it doesn't make me feel better, especially when I see an industry giant touting infringement this and infringement that, all the while profiting from infringement itself. It probably makes _you_ feel better though. :thumbsup

I'm not suing anyone to steal their generic domain names. Don't lump everyone in the domain business in with what you're doing. Most would and do disagree with reverse domain hijacking. :2 cents:

hardsextube is my trademark in hungary... also my domain is registered before your trade mark... you are a trademark troll..

V_RocKs 03-02-2009 02:34 PM

Hard Sex Tube is different enough a judge would let him keep it. Sex is a pretty open word. If it was a problem we would all have to stop using anything with sex.com in it... Like hardsex.com or indiansex.com. Hard is a distinct classification of a sex act. Just sucks that you have to hire a lawyer to keep a website with almost no traffic.

starpimps 03-02-2009 02:35 PM
