If I understand correctly, one way to lose your trademark is through selective enforcement. A "special deal" could be considered selective enforcement. Hdkiller's domain lawyer should read this thread. It might help their case.

from what i read hardsextube had there trademark first... just because it wasn't trademarked in the US doesn't give sextube the right to snatch it. he needs a new trademark lawyer that knows how to do global TM searches before sending out C&D letters.

i agree, i sometimes purchase 6-12 domains when i only need one. just to protect my investment. you'll spend more on lawyers and icann cases, when you could of just purchased the domain in the beginning.
