Do you really need to be such an ass to him? There is no need for Twisty's to try and take his site. Like someone pointed out Shap owns a lot of copyright infriging names. I would like to see LightSpeed come after you.

I am sorry why am I being and ass? he owns a trademarked domain that he built illegally with stolen content and using our trademark? We sent a letter asking him to turn it over, thats his problem, if Steve would like his domain back thats up to him, and if he has the trademark we would by law have to turn it over wouldn't we.

I don't claim to be a trademark lawyer, but from what I have heard / been told, if you know of a site infringing on your trademark, and don't take action, you could potentially lose your mark.

So I don't think it has anything to do with "abusing a policy", but I think it has everything to do with protecting their mark.

Registration date and even trademark date isn't as important as USAGE.

Arguably, since "tube" isn't yet technically considered a generic term referring to a website with videos on it, YouTube could have the jump on all sites with "tube" in them that are operating a similar style video site because such sites are piggybacking on the popularity of YouTube, which has had common law trademark rights since its first usage of YouTube as a video site. From the looks of things, SexTube was still under construction in at least part of 2006 while YouTube was very much in use as a video site.

All that said, given SexTube's usage began before HardSexTube and they are trademarked, they probably will win. But if I were them or any other tube site with "tube" or possibly even "you" in the name, I would not be surprised if sometime in the future, YouTube knocks on their door. Google has bullied others out of their domains/sites before and will gladly do it again with their ridiculous amount of lawyers/money.

What I don't get are people that support copyright infringement but not trademark infringement or vice versa. I don't think Shap would look bad at all in this thread if he wasn't supporting tube sites with stolen content or had typo domains. There's a difference between protecting your trademark/wanting law upheld and thinking law should only apply to you when you can benefit from it and not when you're breaking it or supporting those that break it. You can do whatever you want, but don't be surprised when others don't take kindly to it.

If Steve didn't know about it or any other names that you guys own have trademarks in them it's still trademark infringement. The law isn't broken if you refuse to hand it over it's broken when you used someone elses trademark to make money.

We already are, we have hardsextube.ca which was already turned over, and are continuing to go after the others as I post this.

Correct - that's why sometimes even when names are turned over, the owners are then sued for damages, legal fees, etc. They were breaking the law the moment they infringed on the trademark.

Good luck. You are going to lose affiliates over this. Funny that you are going after people, but you are doing the exact same thing. Which in turn means someone will come and sue you.

Funny thing on that I have had more people hit me up today because of this thread so thats why i keep bumping it, I really don't care what people think, its making me money the more this stays at the top, and in the end we will get the domain, I dont really put faith in GFY legal opinions I pay lawyers for their opinions.

I dropped them too. If a lot of affiliates drop them then maybe that will teach them a lesson. This needs to be posted on all of the adult forums so everyone can see that Michael thinks it is ok to go after people while doing the same thing. :2 cents:
