I know for most of you it's not conceivable that I don't want the traffic. I have enough traffic I don't have to troll for someone elses. The problem is we've invested heavily in SexTube. Both in our Tube version and our paysite. We run SexTube.com 100% legal.

Take a look at hardsextube there is a lot of questionable content on his site. Some content that I feel pushes the young envelope. The last thing I need is for a site like hardsextube to bring heat and hassle to our site that we've worked so hard on. The key for us is that our mark is protected and there is no confusion between the two. Just because there is no confusion to you doesn't mean a surfer or a judge would see it that way.

We've actually had to fight one company that registered officialsextube.com then they registered Sex Tube Inc. I had people hitting me up asking about my new company. That isn't good for my business. I understand why some of you are defending hardsextube. You have to understand there are two sides to this.

I think this thread is blown way out of proportion. This is a business taking the advice of their lawyers to protect its intellectual property. The legal argument is to exercise control over the quality of the product or service of its trademarks. It's the sole reason people bother to get trademarks in the first place. :upsidedow

I am curious to see the outcome though. Ford went after forums and club sites last year, ordering them to pay fines and surrender the domain names. However, in court they were only able to stop these sites from using photographs, depictions or silhouettes, or any similar variation that infringed on Ford's intellectual property. The actual domain name itself was not deemed as an "identifier" of Ford.

If Shap comes out of this thread with a solution agreed with the owner of the site then it speaks volumes for him as a man. I honestly hope he doesn't just take the site off the guy in Court. It seems like a big site and an awful lot of work has gone into it. Would be a shame to see it taken away.

its not about YOUR opinion... its about what US Law, international law, ICAAN and the WIPO thinks.... and there is no such thing as a "worthless trademark" anymore than there is any such thing as a "worthless patent" - either it exists or it doesn't. if it exists, its valid until found to be invalid in a court of law in some particular jurisdiction.

I hope so to. The guy is a special type of guy. He is going around claiming how much bigger he is than me and that he doesn't want to abuse his power. I'm not sure if something is getting lost in translation or if he just speaks that way. My gut and experience tells me this guy is just one of those guys who's not interested in even talking. There's got to be a compromise somewhere here. Obviously hardsextube had no mal intentions of infringing on sextube since no site even existed when the hardsextube domain was registered and developed. Shap, why not ask him for a permanent twistys banner spot or permanent text links to your other tube sites in exchange for not pursuing acquisition of his domain.
