I understand the context fully smart guy. I'm stating the simple fact here that there's a very clear line between crime and TOS violation. Fucking your friends wife, while morally wrong, is not a crime, grounds for a civil suit, or anything else for that matter, it's an ethics issue.

Downloading the content of a website falls into the same category as "fucking your best friends wife". What side of the fence YOU fall on has no bearing on someone else's decision.
