DMCA is not the only law on the books. Check out the FTC and look up unfair trade and unfair competition.

Another thing - just because the DMCA requires you to submit a take-down request, you can still sue. Nothing in the DMCA says you can't.

Yes, you're right. Nobody is arguing those points. Unfortunately the tubes you are referencing don't do those things. Users upload the content. Copyright holders send a DMCA. Tube site removes copyrighted material. Tube site is legal.

Whether or not the users actually upload the content or not is another discussion, but until someone can prove it's the site themselves doing it they comply with the law. So referring to them as illegal is completely false.

not really - there are many videos we made that are uploaded by users on YouTube and it takes some time to remove them too.

No, that's copyright infringement.. a Parody makes fun of original work, it doesn't steal or copy in this case, the original work and use it.

You know what, I have to think this is shit. If this same clip showed up in one of those movies that spoofs on other movies it would be called a parody.

I myself had no idea it was copyright infringement until youtube told me otherwise... it seems you can get away with it, as long as nobody complains.
