What pleasurepays does not get is that Max is getting punished under a bad ruling due to a very poor interpretation of the obscenity law.

This poor law interpretation and bad ruling has serious consequence for the adult industry down the road, if it is not over turned.

Im cool with Max getting jail time for assault and battery or even rape(if the facts support it). I really dont give a shit what happens to the guy. But i do care when Max gets his civil liberties taken away.

WHY DO I CARE?? Because if his can be taken away, so can mine.

You need to look at this case for the facts and without your personal feelings about Max Hardcore. If you can do that, you will really see what a travesty this case decision really is.:2 cents:

He would feel a lot differently if it was him who was hauled off to jail. In my early days of running porn stores I was handcuffed by police and hauled off to jail for some pretty vanilla VHS porn by a crusading police officer and mayor that had larger political aspirations. It's not like prosecutors and the DOJ are saying that vanilla porn is ok, and just the stuff that Max Hardcore produced was repulsive. When they get rid of the Max Hardcores of the world they will move right on down the line to whoever is next. Most of the "internet only" generation of people in porn feel shielded from law enforcement, but it only takes one time getting the cuffs slapped on to change your opinion.

Sure Max Hardcore is an idiot for flipping the FBI and the DOJ the bird, but he doesn't belong in jail for it. You can say 100 times that he should have known better and shouldn't have rocked the boat and deserved what he got, but it doesn't make it any less wrong...

:2 cents:

I fail to understand your comparisons.

Who's an OKAY person in these scenarios:
1: The person taking a pretty girl to their first nude show after picking her up on the street promising easy cash if she just "skips class the next day"
2: The person that at her 3rd nude photo session gets her to do a BJ scene
3: The person that at her 2nd BJ scene gets her to do a hardcore scene
4: The person that at her 2nd hardcore scene gets her to take it anal
5: The person at her 2nd anal scene piss in her face
7: The person that drops her from shoots since she's burned out at the age of 25
8: The person that takes an crackwhore and pay to piss her in the face / shit in her throat and what not

If you think any of the "persons" is "OKAY" then you'd better rethink the business you are in since each step per your definition is "pushing the limits" /abuse of the person (probably with the exception of the crackwhore) and getting them ready for the next step.

I doubt a lot of people goes straight to extreme hardcore unless they are really into that kind of porn.

In either way it's an act between 2 or more consenting adults which shouldn't be judged by anyones point of view but rather if any harm is done or not, unless you live in a country ruled by Islam or similar :2 cents:

If you produce Scat or only shoot amateur college girls that needs quick cash for books doesn't really make a big difference, it's both pushing some personal limits of a person that may or may not be good for the society we all want to live in :upsidedow

i don't think max hardcore is being "rightfully punished" - nor do i have any particular dislike for him. i don't think about him at all. he's just one more idiotic fuck in a cesspool of idiotic, anti-social, dysfunctional "fuck the world" idiots, which this business is full of. i considered going to his trial since i live in downtown tampa out of morbid curiosity but felt i had better things to do. in fact, i think we just forgot about it.

My position is not what a person "deserves" in this case since "deserves" is obviously a VERY subjective notion. To me, its the very simple pragmatic issue that when you are the one pushing the boundaries in the most extreme and in your face "fuck you if you don't like it" manner... you are the one that's going to be attacked. and you are going to be attacked until you are locked up. its that simple. there are no surprises here. there is no epic first amendment/free speech argument. there is just a guy peddling what almost ANY community in the USA would deem "obscene" - and mailing on top of everything else, is retarded. Then coming to a public forum to take the chance to shout "fuck the FBI..." well... i view this all as indefensible behavior and not a great shocker that he's now sitting in a jail cell.

you can only kick a sleeping bear so many times before the bear wakes up and takes you down.

Of course, in a backwards way, we need people like him as a lightening rod. We need a deeply disturbed person to do deeply disturbing things so he'll be the one that gets attacked. But i didn't vote for him, he didn't give me any money from his sales, he didn't check with me before he did anything... so I don't owe him anything. He did what he did for himself and he's paying the price. Everyone knows what the potential price of what he did was.

I don't say he deserves to be in prison because of my careful legal analysis or some deep insight i have into the process or obscenity law, religious affiliation or for anything else. I have only said he deserves to be in prison because he is the one,who by choice, positioned himself as the prime candidate to be the example set by the DOJ. When the jury can't watch the evidence because they are so repulsed by what they see... then there is a problem.

A simple fact about "Max Hardcore" is that even the vast majority of pornographers refuse to defend him, his content or his alleged "rights".. much less, the public at large.

perception is the reality. its not about semantics. its about how a jury/prosecutor and voters perceive the situation. its about a local prosecutors opinion. its about a local law enforcements opinion. its about federal law enforcements opinion. its about federal prosecutors opinions.

it would behoove those who choose to step out into the line of fire to remember those self evident fact.

and since you've missed it... i've said it many times... i think that 95% of people in this business are fucked in the head - which is why they gravitated towards it... from models who were diddled by their uncles to lazy ass scammers who can't do anything if it requires more effort than automating the robbing and stealing from others.

You might also want to ask Nick, who is listed on New Breed Digital, about me. I have actually given him legal advice.

XPlay is also a client. I was just at Mullen's Halloween party last night.

There is one porn girl that I have been banging for the last 3 1/2 years... my GF Vanessa Blue.

If you really want to know about my cases, feel free to search on XBiz, whom I write a column for as well.

Aaah yes, I remember the "shoot" in the HR, I didn't know that was you. Good times, bunch of drunk people trying to make a scene, few people watching making comments.. lol.. From what I remember i was the only one to pull off the pop, (struggling for sure).

I really don't need a client list dude, all I remember was a phonecall from you one time.

Didn't put the 2 together.:thumbsup

have very libertarian views on this matter and dude should not have gone to jail for it.

although not surprised as hypocrisy, hysteria and moral posturing are all too common.
