I was told there was another session in the next couple of weeks concerning this case.

From where I sit - I would sue Shellee Hale before Id sue him.
Why bother going after someone that cant afford to pay damages?

I remember doing an interview with Wired magazine on the AEE convention floor during all of the OneBit antics. The guy sure did know how to get the outsiders involved - Ill give him that!

For those people who came into defense of Pr0 think twice next time when you do business with him. Reading from this and the other donation thread tell you he's as broke as fuck and you could be his next victim.

To be fair, that thread is a few years old. People have turned it around completely a few times in that amount of time. It's possible.

But...

If by protection you mean how our legal system currently works in the U.S. and Canada and many Countries... then yes, anyone can use this - just most people don't need it. It's a registered name you publish for a set amount of time, and a couple other minor fees to pay.

Bit easier in some countries than others.. but either way, it's about as complicated as, getting out of your chair.

I'm sure you saw it all go down since you were involved with Oprano back then. You're probably right about them not pursuing Minusonebit (Keith Kimmel) if it was indeed because he had nothing to pay them. Although he would have been an easy target since he clearly had an agenda to defame them, whereas Shellee may get amnesty behind state shield laws claiming she was merely a reporter.

Agent 488 01-14-2010 01:06 PM

i know canada just recently gave bloggers the same shied protections as reporters recently. dunno if anything similar has happened in the US.

Yeah Ive been involved for a long time and Im surprised I havent been drawn into the lawsuit since I own the damn thing.

Its been odd to have lawyers and the media talking about it but no one has directly asked me about any of it.

I think Shellee has a real good shield case but Im no lawyer. Shes my friend and Im a client of TMM so theres no dog in that fight.

The legal ramifications that could come out of that case would have a far more sweeping impact than the pussified sobbing of post proof or be banned that some have hidden behind for so long.

It wouldnt be up to the whim of the board owner or employee but instead that of the courts. Ill be keeping up with it even though Xbiz doesnt seem to want to as I have little interest in it.

V_RocKs 01-14-2010 01:21 PM

Owned seems to get about 1000 hits a day... + or - 250... Why would he want to "get in on it"?

If I remember correctly, a ruling for this has came out.. she isn't/wasn't protected, because she isn't a reporter or whatever.

Past that... I don't know the outcome.

Nysus has owned Owned.com for years, has never done anything with it, and never will..

He's always thought it was gonna make him a millionaire, but doesn't seem to notice he doesn't have what it takes to make it.

Pro has always seemed solid, but this thread makes me wonder....Something's seriously shady here..

To be honest, I have no idea how pr0 can deny knowing that Nysus was mentally unstable, this has been common knowledge for years.... I'm surprised he hasn't killed himself yet actually.... he used to always talk about it

dynastoned 01-14-2010 01:37 PM

i've done thousands of dollars worth of business on several different projects with pr0 for years now without problem. hes an honest guy and a straight shooter.

that being said i find it hard to believe he'd rip dude off for a couple g's.

You are incorrect.
She is in the middle of a new appeal process to be heard either this week or next... in NJ. Xbiz didnt cover the part and makes me wonder why so I can see the confusion.

Holidays and such have my mind scrambled.

Nice blog you have there BTW.

Was a great name for a radio show a few years ago where we started with calling out a scamming new processor and even had my friend Kevin Mitnick on for some good old internet drama.

Dont know the value of the name though but there are still several people that pay insane amounts of money for a vanity domain instead of established traffic.

Agent 488 01-14-2010 01:59 PM

owned is a huge internet meme. could be killer with the right manager / owner.

I checked for you and got news that her appeal is being heard at Rutgers Law School, once a year they choose a high profile case and they chose hers.

it will be televised and on the radio.

Xbiz was all over this when it started - makes you wonder why they dropped it.

He knows that and many have told him of the potential, there's so many great ideas you could develop with that domain, too bad for some reason he's never been able to get anything done with it. I do remember some of his threads where he half heartedly tried to sell it for some outrageous amount.

Regardless of the law, $2000 is nothing worth even contacting a lawyer over. It'll cost more to just have them review it and draft something up. It's something for small claims court at best.

And even if it was defamation, do you really think Nysus has a ton of money sitting in accounts? That's not a knock on him, it's just you don't sue someone with no money for defamation unless it's some high profile media situation. It'll cost much more to do so than he'd ever get with winning. And defamation cases are extremely hard to win for a number of reasons. You typically have to show malicious intent and in my opinion, Nysus truly believes he has been ripped off.

Thank you Eric for unbanning me. You've always been reasonable and fair over the years.

I'll post my next reply later tonight that will respond to all of the latest posts I find any validity to. It might end up only being posted in the morning but I'll try. It'll include an apology for posting personal details.
