It's all right there... The only mark you can even try to claim is a mark specifically named the absolute name of the domain. You can not try and take something that has additional letters in the domain regardless of what they are. That means I can legally own iSexTube.com if I wanted and there isn't shit anyone can do about it.

Even phonetical differences aren't covered under a mark (sextoob.com, sekstube.com, whatever)...

That is why since they began those bulk emails to everyone with the words "sex" and "tube" in their domain name that they have never and will never take the dispute to ICANN...

they would never win on generic terms like this.. and if they lost just once, they would be out of the game.. so instead they just send out bulk emails trying to get people to turn over their domain names for free.. and some people are just stupid enough to do it..

but when you look at the names they tried to scam years ago that had at least 1 testicle you will see that they knew the law and that is was a scam so they still own their names..

they will never take a case to ICANN because they know they will lose.. and then they will not be able to run their scam...

So according to your logic if the person who owns "xtube" trade marks, then Shap would be in violation of xtube's trademark and would lose.

sex = very common name, nothing unique about it.
tube = very common name now, nothing unique about it
put the 2 together you have a very common name and its not famous.

"twistys" pretty unique name. If someone had a site named "teentwistys" i would agree with you. But if someone has a site called "bbwsextube" that has nothing what so ever to do with violating shap's trademark. If it DOES, then HE IS IN VIOLATION OF the person who owns xtube.

The guy already owns a lot of good tube domains, I am sure he is making good money from them. I don't understand why that isn't enough. I can't believe that he really feels he is entitled to every domain out there with sextube in it.
