As a host, I get my share of DMCA's here and there, and have got some from Eric too. His emails have been nothing but polite, and I've been nothing but prompt in getting any infringing content removed from a clients site. I don't see what the problem is. :helpme

Eric works for many of our studio partners and does a great job for them. Everyone respects Eric except of course for folks who steal content. If you steal content from Eric's clients you will hear from him. Why would that be a surprise? Most everyone knows there is a great deal of piracy in the adult entertainment business, and its not isolated to just Japanese Hentai. Unfortunately, Hentai is so expensive to produce and license it is very prone to theft. Some webmasters - such as Serious Partners - clearly are unwilling to pay for legal use of content. Selling stolen property is a good business if you are crook, but eventually crooks get caught. Yes, there are many lawsuits going on, if anyone has been reading up. Studios are suing tubes and webmasters for pirating, and ASM is doing the same. If the owners of Serious Partners had rights to this content as they say, he would have hired us to make him money. Everyone else in the Hentai market has! Don't be naive folks, don't be fooled. Think! |

If you have legal rights on a content and you paid XXXXXX's dollars for it (have legal license) and someone is trying to abuse you, to make you remove legal content from your resources, you cannot just sit and wait until he performs these illegal and unlawful actions.

Since Eric has clearly 'weighted' the facts in this thread to his favor, I would like to respond with my side of things. 1) I'm not sure what, removeyourcontent. com/temp/ltr3-22onyon4.doc, has to do with anyone. The domain listed in the document has nothing to do with me. The person who owns & runs it is a personal family friend. There was no need at all to call and harass him! Telling him you are going to have his domain suspended because of bad WHOIS information? Considering he picked up the phone listed on the WHOIS contact, that was a bit silly of you to say. Otherwise, I have sent 0 documents, made no statements, and have been wholly hands off with that domain, especially in the context of communication with or about Mr. Green. Eric, stop bugging the poor guy. 2) I do host people; A small percentage of the people I host run their websites on pure user generated content. Does copywrited content sometimes make it's way in? Yes. Have we complied with 100% of Mr. Green's & others DMCA notices up until this point? Yes. The DMCA in question was over hyperlinks to promotional content hosted on a 3rd party website, by a random forum users. As the content at the end of the hyperlink was promotional content. All of it accessible to anyone that signs up as an affiliate. I have no interest in playing policy police for the affiliate program, which is why this e-mail was kindly responded too as we will not remove the content. 3) Eric, I've noticed a massive drop in DMCA notices from you; Coincidently I have also noticed massive amounts of new scanning against my web servers that picked up the same day I said no to the DMCA in question. What ever you think you are up too, I suggest you stop it now. I am not a push-over, I have no problem going on the offensive at the first sign of you causing a true hardship on me, my users or my equipment.
