Here is an article that came out answering a lot of the questions raised on this thread. I know it is somewhat narcissistic since I am the one interviewed, for which I apologize.
But I can't help notice that many of the people against pirate slaying seem to be using arguments that have been flatly thrown out of court every single time. My personal favorite is "You can't prove it". Doesn't the fact that I am calling you (and you know internally that you DL'ed it) show that I either called a random number from the yellow pages and got REALLLLLY lucky, or our software works pretty good. I will be at the AVN show in Jan. If these suits fail, there will be plenty of people there to remind me. If they succeed . . .
