One Time Special Deal Offer For Banned Amazon Affiliates!
 
OK, first of all, the solution I am offering to banned Amazon affiliates is completely legal, does NOT involve any sort of tax evasion and is indeed acceptable to Amazon.

Amazon has banned affiliates in several states, most recently, California. Remember this part, the affiliates located in California were the business entities, whether DBAs, individuals or corporations but at any rate, ALL business entities acting as Amazon affiliates physically located IN California have been banned.

There is nothing in the ban which precludes a California resident from owning or operating a business entity located in a DIFFERENT state in which Amazon has not banned affiliates. There is NO law which precludes a California resident from owning or operating a business in another state. Were there such a law, Californians would be prohibited from owning STOCK in out-of-state corporations, which they clearly are not.

The fact that an individual may own or work for an out-of-state entity in no way obligates that business entity for California sales tax. If such were the case, stockholders in GM who reside in California would be liable for sales tax for GM cars sold in Nevada, which they obviously are not.

Remember, it is quite legal for a California resident to own and operate a business located in another state.

Since California residents are not domiciled in Kansas; that is, they live in California, the best way to do business in Kansas is through a Kansas corporation, which has a legal physical address in Kansas and a Registered Agent who is physically located in Kansas and who has a physical mailing address in Kansas and a post office box will not do.

So here is the solution in step-by-step form to the issues facing banned California-based Amazon affiliates:

(1) The banned Amazon affilate purchases a Kansas corporation through my service at a specially discounted rate. The corporation is good for one year, a physical address is provided, Registered Agent service is provided for one year, a mailing address is provided if needed, Articles of Incorporation are provided, a very professionally done up set of Corporate Bylaws are provided and the entire setup is 100% legal and above board. This is the same service that places like Legal Zoom will charge well over $1000.00 for but I am offering a specially discounted price of $249.00 for EXACTLY the same service.

(2) The banned affiliate can then obtain an EIN (Employer Identification Number) for the new corporation or for a small additional charge, I will obtain that number for the affiliate.

(3) The banned affiliate then registers the new KANSAS corporation with Amazon as the affiliate business entity as the KANSAS corporation is NOT located in California and has no business presence there. Merely having an employee in California does NOT automatically create a "business presence" in that state within the meaning of the term because the affilate is working for the KANSAS corporation. The KANSAS corporation should in fact do NO business in the state of California to ensure that no business presence is established, including opening a corporate bank account in California. With Amazon, you do not need a corporate bank account but you should use the corporate EIN when registering with Amazon as there would be no withholding from income to a corporation if the affilate selects "Exempt From Withholding".

(3) As far as getting paid by Amazon, Amazon does not care where it sends the money, so the affiliate can simply open a personal bank account, select "Wire Transfer", which has a $100 minimum payout and a $15 fee and Amazon will ask only for the Name of the bank, the Routing and Account numbers. If the affiliate wants to be paid by check, a corporate bank account could be opened and I would recommend Bank of America for those as they whould not give the affiliate too much trouble as long as the proper documentation is presented. Another way around this is to use the individual's name as the name of the corporation so that there would be even less trouble depositing into a personal account. Up to the affiliate; makes no difference to me.

(4) Neither myself nor the Registered Agent have any interest in the corporation and the Registered Agent only receives mail for the corporation, most of which is junk mail anyway but will forward any official mail to the actual owner of the corporation at no additional charge.

(5) The Amazon Affiliate then earns and prospers in a legal, ethical and moral manner. All is happiness and justice prevails.`

This method is NOT "tax evasion" as a corporation located outside of California would owe NO California tax of any kind anyway without a physical presence in that state and the Kansas corporation will have none. Quite legal and above board.

As a reminder, no Social Security Number, no business license and no additional fees are required in Kansas for me to set up a corporation for banned Amazon affiliates.

Amazon does not accept affiliates from certain states, including California. Amazon does accept affiliates from Kansas. In this instance, the KANSAS CORPORATION is the business entity which has affiliate status and KANSAS is NOT banned by Amazon. Makes no difference who owns stock in the corporation or who works for the corporation. The CORPORATION is the affiliate, NOT the individual and the LOCATION or RESIDENCE of the corporation is the key.

It would be best however for the INDIVIDUAL or the CORPORATION to have a receiving bank account in a non-banned state. Easy to open savings accounts and bank accounts online in UNBANNED states. If a local address is needed in the UNBANNED state, a UPS Store box can be opened quite easily and that address used for mailing and address purposes. This can actually be done over the phone and via the FAXing of required documents.

Amazon accepts individuals AND corporations as affiliates as long as they are not based in a banned state. Again, KANSAS is NOT a banned state.

See?

So easy, even a cave man could do it!

TOS are TOS, just like on any other affiliate program. You don't need PERMISSION to abide by the TOS.

Amazon accepts affiliates from KANSAS, as KANSAS is not a BANNED state, therefore any business entity located in KANSAS can sign up as an affilate, just as any business entity in any other UNBANNED state may sign up as an affilate with Amazon.

Ok, so you are surmising, from the terms of service that Amazon has on their site that this is acceptable.

BUT, you do not actually have, in writing, a statement from Amazon that your plan, as outlined here is acceptable to them.

So, your lead paragraph is a touch misleading I would think.

It might be a good idea to actually run this past Amazon and get such a statement as that would give a high degree of credibility to this.

The corporate address would be out of California. It's a technicality. However if you want to set up an out of state corporation no one choses Kansas. Think Delaware, Nevada ......

You could actually ask them and if they said yes, it is acceptable (as I assume they might) then you would have a statement from them that you could back up your statements with.

Yeah, right but rather than waste a lot of time emailing Amazon, I simply signed up with Amazon myself, using my corporate info and my corporate bank account. Following is the text of the email I received from Amazon with private information removed; they will probably not like my website as it has little content but the point is that I was indeed able to sign up as a KANSAS CORPORATION using my CORPORATE BANKING INFORMATION AND EIN!:

And the aswer is this:

The KANSAS CORPORATION is the business entity registered with Amazon, not the individual WORKING for the coporation. Kansas is NOT a banned state and the corporation "resides" in KANSAS, so Amazon will approve the affiliate signup. It is quite legal for a person in one state to own a corporation in another state.

The affiliate should use a Vumber Number with the appropriate area code for the affiliate signup in cases of corporations I set up, which area codes I will provide to those who purchase my service. Costs a couple of bucks a month and that number is then forwarded to the affiliates home or business number. Amazon can't tell a Vumber Number from an actual hardline number, so no sweat there.

Have the money sent to an online bank located in a state which is NOT banned by Amazon, as there have been some things come up in the last few days indicating that Amazon might not send money to banned states, so rather than risk it, just get a different account in a state which is not banned. Very easy and free to do in most cases.

Need an out-of-banned-state address? I can help you get one and very easy to do but remember, the address of the corporation is ALREADY out-of-banned-state and I will forward mail on request. If mail forwarding gets crazy expensive and I'll hit you up for a few bucks for postage but otherwise free.

Use your own webmail from your own website to use as the signup address as Amazon does not really like free email addresses and you are good to go.

Remember, the business entity which has become an Amazon affiliate is located in KANSAS and it then makes no difference where employees of that corporation live or work, not that I'd make a big deal of it with Amazon but they know it. They really don't want to lose affilaites, they only want to bring the various states in line with the 1992 Supreme Court decision which ruled the whole tax thing unconstitutional. The various states are trying an end run around it but will eventually fail.

The "residence" of the affiliate, which in this case is a KANSAS CORPORATION is in KANSAS, which is NOT a banned state.

By the way, Amazon asked ONLY for the CORPORATE info and NO personal information of any kind; only CORPORATE info other than a contact name for the corporation for which I gave them the name of a guy who works with me. When Amazon asked for a name to use for the name of the account, I gave them the name of the CORPORATION and it was accepted as is shown in the email reproduced in an earlier post.

My plan or "system" works and works well.

Remember:

1) A Social Security Number (SSN),is not required.

(2) Kansas has no Gross Receipts Tax (GRT). Only profits of the corporation, if any, are taxed.

(3) Kansas requires no state business license unlike other states, which might be quite expensive.

(4) No "DBA" (Doing Business AS) filings are required in Kansas, which can also be expensive.

(5) It is possible to completely control and operate your Kansas Corporation in PRIVACY. Your name does not need to be revealed, especially on publicly accessible documents.

(6) Kansas does not require a Resale(Sales tax)or Wholesale Tax ID number although a registration can be beneficial, when appropriate.

(7) Incorporation in Kansas is inexpensive and One Stop Corporation Shop provides Resident Agent Service as well as a permanent street address for the corporation and additional mailing services when required.

(8) The original Incorporating Director need not continue to hold that position, such that new Directors may be appointed whose names do NOT appear in publicly accessible documents.

(9) Kansas has a VERY low tax structure for corporations, with a rate of * 4% of taxable income, plus surtax of 3.35% of Kansas taxable income in excess of $50,000 for all tax years. Remember; a corporation pays tax ONLY on its profits and any decent corporation will not show a taxable profit for several years, if ever.

(10) Annual renewals for Kansas Corporations are low in cost, allowing you to inexpensively maintain your corporation or many years if you so choose.

(11) Kansas does not require publication of the bylaws of the corporation, thus ensuring yet another level of privacy for those actually operating the corporation.

Ok, yesterday I asked Amazon myself whether this would be acceptable or not. Btw, I asked this before anyone started saying to send the stuff to Amazon as Spam. When you were dodging the question as to whether you had asked Amazon directly whether it was acceptable or not I decided to ask them myself. So, this was not an attempt to fuck with you or your biz. It was an attempt to get a legitimate answer.


What I posed to them was:

OK, first of all, the solution I am offering to banned Amazon affiliates is completely legal, does NOT involve any sort of tax evasion and is indeed acceptable to Amazon.

Amazon has banned affiliates in several states, most recently, California. Remember this part, the affiliates located in California were the business entities, whether DBAs, individuals or corporations but at any rate, ALL business entities acting as Amazon affiliates physically located IN California have been banned.

There is nothing in the ban which precludes a California resident from owning or operating a business entity located in a DIFFERENT state in which Amazon has not banned affiliates. There is NO law which precludes a California resident from owning or operating a business in another state. Were there such a law, Californians would be prohibited from owning STOCK in out-of-state corporations, which they clearly are not.

The fact that an individual may own or work for an out-of-state entity in no way obligates that business entity for California sales tax. If such were the case, stockholders in GM who reside in California would be liable for sales tax for GM cars sold in Nevada, which they obviously are not.

Remember, it is quite legal for a California resident to own and operate a business located in another state.

Since California residents are not domiciled in Kansas; that is, they live in California, the best way to do business in Kansas is through a Kansas corporation, which has a legal physical address in Kansas and a Registered Agent who is physically located in Kansas and who has a physical mailing address in Kansas and a post office box will not do.

So here is the solution in step-by-step form to the issues facing banned California-based Amazon affiliates:

(1) The banned Amazon affilate purchases a Kansas corporation through my service at a specially discounted rate. The corporation is good for one year, a physical address is provided, Registered Agent service is provided for one year, a mailing address is provided if needed, Articles of Incorporation are provided, a very professionally done up set of Corporate Bylaws are provided and the entire setup is 100% legal and above board. This is the same service that places like Legal Zoom will charge well over $1000.00 for but I am offering a specially discounted price of $249.00 for EXACTLY the same service.

(2) The banned affiliate can then obtain an EIN (Employer Identification Number) for the new corporation or for a small additional charge, I will obtain that number for the affiliate.

(3) The banned affiliate then registers the new KANSAS corporation with Amazon as the affiliate business entity as the KANSAS corporation is NOT located in California and has no business presence there. Merely having an employee in California does NOT automatically create a "business presence" in that state within the meaning of the term because the affilate is working for the KANSAS corporation. The KANSAS corporation should in fact do NO business in the state of California to ensure that no business presence is established, including opening a corporate bank account in California. With Amazon, you do not need a corporate bank account but you should use the corporate EIN when registering with Amazon as there would be no withholding from income to a corporation if the affilate selects "Exempt From Withholding".

(3) As far as getting paid by Amazon, Amazon does not care where it sends the money, so the affiliate can simply open a personal bank account, select "Wire Transfer", which has a $100 minimum payout and a $15 fee and Amazon will ask only for the Name of the bank, the Routing and Account numbers. If the affiliate wants to be paid by check, a corporate bank account could be opened and I would recommend Bank of America for those as they whould not give the affiliate too much trouble as long as the proper documentation is presented. Another way around this is to use the individual's name as the name of the corporation so that there would be even less trouble depositing into a personal account. Up to the affiliate; makes no difference to me.

(4) Neither myself nor the Registered Agent have any interest in the corporation and the Registered Agent only receives mail for the corporation, most of which is junk mail anyway but will forward any official mail to the actual owner of the corporation at no additional charge.

(5) The Amazon Affiliate then earns and prospers in a legal, ethical and moral manner. All is happiness and justice prevails.`

This method is NOT "tax evasion" as a corporation located outside of California would owe NO California tax of any kind anyway without a physical presence in that state and the Kansas corporation will have none. Quite legal and above board.

As a reminder, no Social Security Number, no business license and no additional fees are required in Kansas for me to set up a corporation for banned Amazon affiliates.

I did not ask them about changing addresses. You can see in my post exactly what I wrote to them.

I tried to make it sound as if I was in the process of establishing an associate account and wanted to know if this method was ok with them.

An affiliate living and working in New York with a registered company in Costa Rica is deemed to be conducting business in New York and NY laws apply.

I can't speak towards the credibility/good quality/etc or anything like that of this offer.

The principle behind it seems legit though to open the business entity...

1. I have had a business entity I opened in one state and I then moved to another a few years later. It was still treated as being a resident of the state it was opened and registered in.

2. Its not illegal for "skipping" on taxes as you would still pay California state taxes when you took your "pay check" that you need to report as income in which will get state taxed like fuck... we know they rapin everybody out there.

3. Who cares what amazon thinks? If you fill out the forms truthfully and amazon accepts you and pays you then fuck them... seriously, what can they do? Plus the only reason they cancelled cali affiliates is because the sales tax, which if they don't need to pay it through your out of state corp, why would they care you were back in as an affiliate?

Don't forget you still have to pay *$800 california* tax if ur in california. NOT paying it is ILLEGAL, whatever this scammer is telling you.

There's nothing wrong with getting a business in another state, but California still requires you to pay $800/year.
