Better start filing counter-suits.

Not the same standard form letter that everyone is getting?

Ludedude 11-12-2003 06:27 PM

Is it the standard form letter or did they really server you with papers?

Ludedude 11-12-2003 06:27 PM

haha 3 responses all the same :1orglaugh

webgurl 11-12-2003 06:28 PM

The same letter as everyone else or they are persuing actual legal action ?

Jon 11-12-2003 06:28 PM

Well..

The best part about this, is I don't violate any of their patents.. I've got no streaming audio or video on any of my sites. I don't even run paysites or MGP's for the matter. All I do is SEO... Can I counter sue them for trying to extort funds from me when I didn't infringe on any of their shit?

Jon 11-12-2003 06:28 PM

No.. they served me. Not a standard letter.

No, but you're linking to paysites that DO "infringe" on their patents, which means they also want your ass.

Ludedude 11-12-2003 06:30 PM

Lovely. How the hell do they plan to prove infringement when you don't stream shit? How far up their ass do they have their heads?

Sounds like you just got the letter 90% of other people got... don't be worried if your not infinging on them. Just toss it in the fire place. :glugglug

Call the guys at IMPA and talk to them before you have your lawyers respond. If Acacia is harassing you and you have nothing to do with their patent, that might be helpful information for the judge in the case to know about.

Countersue for extortion and illegal business practises.

StuartD 11-12-2003 06:31 PM

I do believe they can get you just for linking to sites that have streaming, or video/audio files.

So if you have a link to a site at all... or a program... then you would be violating their patents.

But.. I am not linking to a page with the stream. Just the site, and you can't see the stream unless you pay. This is gay.

What?

Jon 11-12-2003 06:34 PM

Furthermore.. Does this mean that the TGP and MGP guys that LINK to sites that do streaming will be subject to getting their asses sued as well?

Yes, according to them all the link sites are infringing. Got google?

Doesn't have to be to a page that has a stream. Just to a website that has video/audio on it somewhere. Basically, if you link to a company/program/website that practices the transmission of video or audio over the internet, they see it as a violation of their patent.

Of course it's gay, because Berman loves dropping to his knees to suck the big black cock. This my friends... is what we call the truth!

That's kinda slim standings for them to go after websites that are linking to other websites with videos. All he has to do is show that Acacia hasn't shown what websites have the license and show how it would ruin the internet if Google, Yahoo and all the other search engines and directories were to be sued for the same reason.

I have a feeling that a judge would just throw it out of court if the judge had any understanding of the internet. But that just a feeling, not what the law says (if the law says anything about it).

Yes I am...but he has not answered that question...he says "served," I want to know if they actually used a process server...seems like it would be kinda extreme since he's in NY.
