And if he is any good, have him developed a virus/file that can be hidden in a video tube site upload that will delete any and all stolen WMV's and all Mov file when downloaded or viewed illegally off of the downloaders hard drive.

You can't send someone to break into a house because your property is in there and you want it back.

It's just the way it is, this situation sounds like the same deal. Whether the domain and content is yours or not, you cannot 'break into' the server to liberate it.

The only way it would be legal is if the domain & server belong to you and a rogue staff member locks you out of your box. (I know this it happend to me)

Solution: Your hosting company can give your access back they almost always build a back door so they can give control back to the owner or themselves in a case of non payment.

Hosting companies don't "build in a back door". They have physical access, they don't need a backdoor.

To the OP: Like others have stated, this is not legal.

If you actually have to break in to get back your property then, yes that is illegal.

However, if you can back your property without actually breaking in then that is ok.

I have had a few people claim they needed to get someone to break in and get their pages and images and have solved it with wget or a spider app.

Your best bet is if you signed any contracts with your programmer. Get those documents to an attorney and get a "Motion to Retain Interest of Property" from a court (This WILL require a lawyer... and WILL take some time.)

Once the judge agrees you are owner of the material, then your attorney will subpoenae the server company for their records... 99 percent of the time, the server company will just turn over the material at that time.

Once you have the material, send a formal complaint to your programmer with "Intent To Sue" letter.

Again, this will take time and does require a lawyer...

For FreeBSD, Linux, Solaris you can just boot in single-user mode and reset root password.

For Windows server, it's probably more of a pain in the ass but can be done as well.

First, no. Physical access will always give you root access, if you have a clue.
