This is just one of his threads under numerous usernames. Not a very good salesperson to say the least... I suspect this domain will be available for years.

It wasn't a threat. No court of law would determine that it was a threat. GFY's standard for rule infractions is far different than a court of law. I would love to watch you get laughed out of court if you tried to file a complaint based on that post. Plus, it would be funny to hear that post read out loud in a courtroom.

3 domain appraisal I have asked told me that the domain is worth around 10-12.000,- dollars. One of them have even contacted Moniker with that offer, but I guess you dont want to sell it for real money

This is clear and obvious defamation will not be tolerated. This is your opportunity to resolve this matter without legal expense and exposure to liability and damages.

If ALL of the offending posts are not removed within 72 hours, further legal action will be taken.

A record of all of your offending posts have been recorded for potential evidence in a civil case against you.

This will be your only warning.

I'll be contacting GFY and making them aware of the situation as well. Thank you for your prompt attention to this matter.

If the defamation improperly accuses victim of a crime or reflected poorly on victim's profession, the court or jury may award damages.

Defamation victims may seek both actual damages to recover from the economic harm that you have suffered, and punitive damages to punish the person who made the remark and also to serve as an example to deter others.

So, it earned $10,000 for me over the last year (with ppc only) and you still think it is only worth 10-12k? I don't understand your decision making process. I'll just hold on and earn another 10k and watch the value of the name increase as domain name values increase across the board. Heck, I might even find a better deal with ppc, or a direct deal that might bring in many times the current earnings.

Why did Eric cancel your account? He even said you made what he considered a death threat to me which is why your accounts were removed.

You have no idea about law. You probably don't even know which posts I'm talking about.

It is funny that you are confirming that you are the same person that made the threats to me. Why haven't you made more threats, if you aren't worried?

You are a fuckhead, you always will be a fuckhead, and you will never sell your domain name here. No matter how many posts you start as other people.

What exactly is a lie? I need to know if you feel like becoming another defendant. Remember, you did this to yourself.

What is it that we both know is a lie KimJI????

Spiegelau 07-05-2007 05:39 PM

Listen KimJI,
Since a complaint has been drafted and is ready to be filed against "John Doe" aka "Fris" on GFY, how much more do you think it would cost to tack on your name for your false statement? Let me clue you in . . . . if you don't clarify, you will be "John Doe #2" aka "KimJI" on GFY.

You are clearly stating that my post is deceptive and there is only one manner in which you could be referring. All it takes is common sense and the rule of law.

I won't mind adding as many names as possible. This will be the easiest case ever decided by whichever judge is assigned to this case. All public documents will be posted in this thread as they are filed with the court.

What is "Libel Per Se"?

When libel is clear on its face, without the need for any explanatory matter, it is called libel per se.

Yes, I think I will be laughing that hard. I suggest you consult your attorney about defamation and libel and then join me in laughing. One other possibility is that you could be exposed as one of the "anonymous" posters committing libel. That would be fun as well. Either way I invite you to join me in laughing x1000!

Under the normal rules of discovery in civil lawsuits, parties to a suit can simply send a subpoena to anyone they believe has information that could be useful. That information doesn't even have to be relevant to the lawsuit, as long as it could possibly lead to the discovery of relevant information. The only way that a court will evaluate an identity-seeking subpena is if either the ISP or the target of the subpoena files a motion asking the judge to block the subpoena. Unfortunately, in practice that rarely happens.

chupacabra 07-05-2007 06:19 PM

so its your domain to sell now "Splegelau"? weird, in your other threads you insisted it wasn't, i take it you just acquired recently from one of Gregs personalities?

btw, everyone please keep in mind... *************** has been tainted due to the insane actions of its owner, and has now left a searchable trails across the web on forums everywhere. great to have a *verifiable* history of it being unmovable for years by its current owner/victim and ridiculed by the fora populace, not to mention all the animosity associated w/ the name *************** as it sits now from its wacked-out, threatening schizophrenic salesman.

*************** is the albatross of the domain world, don't let it sink your boat like it obviously sank its current owners mind..!

Spiegelau 07-05-2007 06:21 PM

Now, for everyone else . . . . let's get back to the subject of this thread!

*************** welcomes you to this thread my friend!

Insults and arguments are also welcome!

The only thing not welcome here is defamation.

Defamation and libel will be prosecuted to the fullest extent of the law!

Stay tuned for details of the case as it unfolds.

Thank you for acknowledging the fact that you have been warned and refused to rectify the issue. All the more reason for a quick decision by the courts. Get out your checkbook Fris.
Also, an additional libel statement can be added to the complaint. Thanks "Fris"!

ATTENTION INVESTORS!

Looking to invest your money? Stocks can crash, Bonds earn nothing, risky other investments just won't do.

Welcome to a great opportunity to invest in a high quality, type-in domain name!

*************** is a very nice, generic domain name (with valuable, reliable type-in traffic) that can be used in either mainstream, or adult.

The immediate (and permanent) earning potential of the type-in traffic eliminates the risk of the investment while the generic nature of the two desirable, popular words provide additional potential for unrestricted future growth in the asset's value. *************** is a bargain at $120,000.00!

Great for your defense! Too bad I will be sending a subpoena to that "sedo employee" and they will be asked to repeat this "information" in a court of law. In wich case they can be imprisoned for false testimony. It will also be another brick in your judgement wall.

I can only imagine what a judge will decide after you've been repeatedly warned and offered a solution, yet, instead you decided to continue to libel. This will go down as the easiest case in history. Of this I am certain.

In any event, I am at the courthouse all the time and can't wait to see you there my friend! Prepare your defense the best you can. I can't wait to laugh out loud at it!

Common Sense 07-05-2007 07:14 PM

It was only a matter of time before this loser brought out the fake attorneys and fake lawsuits. Im surprised he didnt bust it out in page 4.

The guy cant afford an attorney, he has been spending hours everyday begging people to buy his overpriced domain name. If he had a penny to his name, he would be building the site out for himself or just letting it earn the money he claims it does. But he is broke, is desperate for money, and the laughing stock of the domain industry. If he took the time he has spamming and begging people to buy his domain and worked at McDonalds, he would have made what he is asking for the domain by now. When all is said and done, the domain is really only worth about 10k, and when you sell it, you will have made about 30 cents an hour off it since you spent 4 years begging everyone to buy it.

And since you like to talk law, pretending to be other people and misrepresenting the domain that way is fraud. Read up on it. If someone buys the domain off you based on your fake nicks praise of it, you could be charged with fraud. Read up on the law, you have been nothing more then a fraud on this board.

I anxiously anticipate your imaginary lawsuit from your pretend lawyer. The only truth to your posts are that you are at the courthouse all the time. But its begging for change holding a dixie cup.

How funny will it be when it turns out that many of these GFY board identities end up being controlled by the same pos loser.
