So Fucked

My second court date is Feb 5th for a speeding ticket, I just filed for disclosure and got all the evidence they have... It also shows the type of radar they used so I looked it up and here it is... I guess I cant use the "wrong car" defense...

Maybe you'll get lucky and the cop won't show for the court hearing. Or next time do what i did last week - pay the ticket!

Is that "QAG 921"? Or "OAG 921"?

And why are you driving the 'soccer moms' car, and not the hummer? or the Lamborghini? If you're going to get a speeding ticket, you may as well be in the Lamborghini, and be flashin' a Pipecrew hand sign out the window.

A while back I got a ticket in the mail and it had a cross street reference for a town, I've been to twice. I disputed it, and when I saw the pics... it was the wrong car, wrong plates, wrong person... WRONG EVERYTHING. When we purchased our car, the DMV sent the plates to the wrong person. And now our original plates that we should have received went to some jackass down in Century City. I hope he never decides to rob a bank.

There is still a chance to beat this. Cops make mistakes all the time, and a good traffic lawyer can often find a loophole. For instance, they may not have sufficient proof that you were driving, and in some states (at least) it is a driver who is responsible for speeding, not the owner of the car.

Here in Texas, there isn't really a set speed limit per se. It's a "recommended" speed limit. So you can usually get off if it's not too much over.

I've had about 4 speeding tickets get dismissed for one reason or another, for a $55 attorney fee

Do they have deferred adjudication where you are? Just pay the court fee, don't get another ticket in 3-6 months and it doesn't go on your record.

speak to the prosecuter ahead of time and see if he will drop the points if you pay the fine, most of the time they will... if not get a lawyer if you cant afford the points

Sounds pretty relaxed over there... Its a lot harder to get out of speeding tickets/ fines here in Aus..

And now they have implemented anti-hooning legislation which gives police the power to confiscate and impound your car...

If you were the only car in the area then you're fucked.
My boyfriends mom disputed a radar ticket because the cop had claimed it was her car that was speeding (oh and it was). But in order for them to have gotten an accurate reading, they would have magically had to have gone THROUGh the van that was next to us.

There are ways to dispute it, just keep digging

Well, in sacramento, I can tell you that police have to 40 hrs of radar training. You can ask if the radar was in stationary or moving mode. The officer has to estimate your speed within 5 mph of the radar's displayed speed. Ask the officer when the last time he re certified at radar school. Ask when the last time the radar was caliberated. There are several ways to get out of radar tickets.

Tell me some more on what exactly happened.

"Here in Texas" - like its another fucking country... and when you make it to the city someday, you'll find there is a fucking speed limit, you just get the over/under up to about 10.

however in texas, you can't get a ticket w/ a picture. you have to physically be pulled over. the dps will send you picture tickets, and most ppl pay up, but if you call they start scrambling.

Haha...thanks for the laugh. Funny that I live in a metroplex of 5.2 million. However, I do ride a horse to work and wear a cowboy hat. Give me a fucking break...this is the 18th city I've lived in. Who knows though, maybe one day I'll move to the city, huh?

In any case, less than 3% of speeding tickets end up being challenged, so you have some sort of odds on your side. Like recommended before, talk to the prosecutor. Chances are you can at least get deferred adjudication.

i thought everyone in texas wore cowboy hats? all i know from texas is what i've seen on dallas.
and this would be where the actual speed part comes in --

Operating a vehicle in excess of the following speed limits is prima facie evidence that such speed is not reasonable and prudent and is unlawful. Tran. Code §545.352(a)
A) 70 MPH during the daytime on "numbered" highways outside an urban district for passenger cars(2) and motorcycles Tran. Code §545.352(b)(2)
B) 65 MPH during the nighttime on "numbered" highways outside an urban district for passenger cars2 and motorcycles Tran. Code §545.352(b)(2)
C) 60 MPH during the daytime on highways that are not "numbered" and that are outside of an urban district for passenger vehicles and motorcycles Tran. Code §545.352(b)(3)
D) 55 MPH during the nighttime on highways that are not "numbered" and that are outside of an urban district for passenger vehicles and motorcycles Tran. Code§545.352(b)(3)
E) 60 MPH outside an urban district unless another speed limit has been established by law. Tran. Code §545.352(b)(4)
F) 30 MPH in an urban district Tran. Code §545.352(b)(1)
