That never works. Cops pull cars over for shit like "you screeched your tires" with no way to prove they heard screeching tires. The reason they get away with it is because generally if it's word of cop vs. word of citizen, word of cop wins.

Police state is the end game. Period. Never thought I would see the day when the powers to protect were the same to possibly injure, or worse, kill mine based on a construded human sense that has error without accountability. Law, has given the police the keys and they will abuse this power as history shows, without recourse they Will abuse it to best of their ability.

Not sure about American law but in Canadian law, the smell of burnt marijuana isn't enough by itself to allow a search, the reason being that burned marijuana is already burned and there is no proof that the person is in actual possession of the drug. Last time I checked at least.

But the Conservative majority coming into power means a lot of that might change

I'm not advocating the legality of using pot, but I think this decision sucks for our fundamental rights.

Does this mean cops can now bust down someone's door claiming rape because their wife/girlfriend is a screamer in bed or claiming child abuse because someone's baby is crying?

In other words, they forfeited their own constitutional rights by their own actions. Had there not been the attempt to destroy evidence, any evidence would have been gained by an unlawful search and could be ruled not admissible in any proceeding against them.

The ruling was 8 -1 BTW

where i live now, a previous renter said there was marijuana odor in the hallways, which isn't closed you can see the parking lot and lake on each side, because some neighbors were smoking joints. Someone called the cops and since the hallways are shared the cops went on spree entering apartments - naturally they had to go in and search her apartment as well while trying to figure who the pot smokers were.

No warrant, no anything. Just based on smell cops enter looking for drugs because your neighbors are potheads! Pretty screwed up
