canadian bit torrent user fined by US court

http://torrentfreak.com/canadian-bit...-court-110615/

Quote:
A new dimension was just added to the ongoing stream of BitTorrent lawsuits in the U.S. A Canadian BitTorrent user has been ordered to pay $60,000 by a U.S. District Court judge. The Calgary resident, who did not defend himself, was ordered to pay the damages for sharing two films on an adult-oriented BitTorrent tracker.
considering the treat that they are talking about (berne convention) only recognizes the registration of copyright for enforcement under the laws of each country.

and not the right for US laws to supercede their foreign counterparts law

this judge seriously errored on his decision.

this case should have been tried in calgary under canadian laws.

The important thing to take away from this case is that if you are a Canadian being sued in the United States, you should not ignore it. If you do, a default judgment will likely be entered against you, and it will almost always be enforceable in Canada.

if i remember correctly about this case the web site was hosted on a us host provider

who happened to have a jurisdictional requirement in the contract that dictated a US state for all disputes (not just disputes with the host)

that is a significant difference between this case and that one.

but there is no possiblity to argue that the judgement violates a jurisdictional issue in that case.

there is such an arguement in this case.

I can't wait for them to fine gideon. Then, since he has no job and no money, he won't be able to pay the fine. Then it's off to prison for GG. I hope he timeshifts his first anal sex with a big black cock.

He might love prison, FREE food and lodging, FREE sex. He was also advocating FREE internet access by prisoners in another thread. Maybe he sees the writing on the wall?

You know what? You are 100% correct! Prison would be the perfect world for GG. Plus his parents would FINALLY get him out of their house and wouldn't have to pay for everything for him.
