Know Your Rights When Dealing With Police Officers

A Police Officers Worst Enemy Is A Well Informed Citizen Who Knows Their Rights!

Police officers hate to hear these words:

"Am I free to go?"

"I don't consent a search."

"I'm going to remain silent."

When a Police Officer Stops You

To stop you a police officer must have a specific reason to suspect your involvement in a specific crime and should be able to tell you that reason when you ask. This is known as reasonable suspicion. A police officer usually will pull you over for some type of "traffic violation," such as speeding or maybe not using your blinker. Throwing a cigarette butt or a gum wrapper out your car window is reason enough for the police to pull you over, ticket you for littering and start asking you all sorts of personal questions.
Your Rights During a Traffic Stop. Top Five (5) Things to Know About Protecting Yourself from the Police:

#1 - Safety. The first thing is your safety! You want to put the police officer at ease. Pull over to a safe place, turn off your ignition, stay in the car and keep your hands on the steering wheel. At night turn on the interior lights. Keep your license, registration, and proof of insurance always close by.

Build a trust with the police officer be a "good citizen" be courteous, stay calm, smile and don't complain. Show respect and say things like "sir and no sir." Never bad-mouth a police officer, stay in control of your words, body language and your emotions. "All this takes practice, try practicing with a friend." The idea is to get the police officer to understand that you're just an average ordinary citizen and let you get on your way down the road. Never touch a police officer and don't run away!

#2 - Never Talk To A Police Officer. The only questions you need to answer is your name, address and date of birth and nothing else! Instead of telling the police officer who you are, simply give him your drivers license or I.D. card. All the information the police officer needs to know about you can be found on your drivers license. Don't volunteer any more information to the police officer, if he ask you any other questions politely say "Am I free to go?" and then don't say another word.

#3 - I'm Going to Remain Silent. The Supreme Court has made a new ruling that you should Never Talk to a Police Officer without an attorney, but there's a CATCH! New Ruling Before you're allowed NOT to talk to a police officer, you must TELL the police officer "I'm Going to Remain Silent" and then keep your mouth shut! (How can you be falsely accused and charged if you don't say anything?) Anything you say or do can and will be used against you at any time by the police.

#4 - Just Say NO to Police Searches! If a police officer didn't need your permission to search, he wouldn't be asking. Never give permission to a police officer to search you, your car or your home. If a police officer does search you, don't resist and keep saying "I don't consent to this search."

#5 - "Am I Free to Go?" As soon as the police officer ask you a question ask him "Am I free to go?" You have to ask if you're "free to go," otherwise the police officer will think you are voluntarily staying. If the police officer says that you're are being detained or arrested, say to the police officer "I'm Going to Remain Silent"

I was a reserve deputy for Maricopa County in AZ for 18 months about 16 years ago. Every point in that post is totally correct and it's all stuff that I already do.

Good advise.

Cops are now the front line of their departments desperately needed revenue stream. They pull you over for money. The money generated by your traffic offense, the money from taking possession of your vehicle if it can be confiscated. Be careful.

"To serve and protect" is no longer the primary goal of most police departments.

its funny for the people that think this shit actually works. If your not secretly recording this all happening. Whatever they write on the paperwork is what he court is going to see. He's not going to write "i was given no consent to search, but searched anyways, the person kept asking if they were free to go blah blah"

While it might not hold up that well in court if you don't consent to search, it still might make them think twice about doing it. They can get into a lot of trouble -if- you are found to have not consented and they had no reason to search.

Check this story out. Just broke here in town, but happened almost a month ago:

Woman arrested in her own front yard for not obeying an inexperienced officers order to stop filming him. She broke no laws and was well within her rights.

Dude...you have to watch this one.

Patrolling only the side of the highway where the money comes and not the drugs. And roadside fights between different agencies for the money. It's nuts.

i agree it's nuts. But when I look at that guy and then I try to figure out a logical explanation for keeping 200k shrink rapped and hidden in your tractor trailer, I cant figure it out.

Leading to? We're living it here in the US today and now.

Police can now break down your door if they HEAR sounds and decide those sounds could be someone hiding evidence. Maybe you're walking to the door, maybe you're flushing a toilet, maybe you're running the microwave or feeding your baby. If they want to say they heard sounds of you eliminating, hiding, destroying evidence of something, the courts say they may break down your door and arrest you. And dont forget, it's standard procedure to shoot your dogs in the head upon entering.

Come on now. Don't all Armenians carry that kind of loot around in their tractor trailers?

But shit, driving through TN with that kind of money, after seeing that video...I'd be shink wrapping and hiding as best I could, my $200k.

at least it gives your lawyer something to work with... it's probably not easy, but if he can somehow prove that there are some inconsistencies in the paperwork, good chance you will be found innocent when it comes to trial...

I don't understand why people fear the police. If your an honest abiding citizen, they talk to you briefly, and then quickly move on.

If police want to search me, my house, my car, fine. I've got nothing to hide.

Are come cops crooked? Of course you have some bad apples. But the odds of one of them coming after you is pretty slim. I can't remember the last time I talked to a police officer....

Click the links I posted above about the local girl arrested in her own yard for filming what she believed to be an illegal search (where the guy was let go with no charges).

This one idiot cop is just one reason why people don't want to deal with the police.

The Tennessee video is just another example of the cops neglecting their job of protecting and serving, while keeping their own jobs safe collecting money instead of drugs.

Aren't you Canadian? What do you know about American Fascism then?
Canadian cops probably buy you some back bacon and beer after stopping you.

it's funny when you watch the cops shows how much info the suspects give the cops. they totally fuck themselves as the cops are building their case against them. i've yet to see one say they want to remain silent and speak with an attorney.

If I am not mistaken though if you refuse a search at a traffic stop, cops have a right to detain you and call for a sniffer...you've just given them probably cause. That was on AMW so I do not know if it is true, but...

Good advise and great points to stand by

These things have worked very well for me. Especially when I used to be a pot head years ago and I encountered police regularly. Now that I'm not doing anything wrong I don't get stopped as often. Now if I talk to police it's mostly about security work we're doing, a house we're hitting or something.

Just one thing to add. Assume that the cop is tired from working a long shift after having worked his other job earlier that day and be super polite as you refuse. You don't want to come across as "an uncooperative SOB", but as a nice guy who knows his rights. Say something like "I'm sorry but I really need to get going so I can't consent to a search right now." Cops are people first and foremost and like all people they'll generally be nice to someone who is nice to them first. If you're an asshole to them, they will often respond in kind.

I once ran right through a red light right in front of a cop. I was out of state and didn't have my license or insurance with me. To top it all off, I was carrying a pistol. He let me go without even a written warning! Partly this was because I treated him with the same courtesy a I treat a customer. So refuse the search, but do it very politely.

Also watch for "you don't mind if I take a quick look back here" as they open the door. "You don't mind" is always a question and the answer is "I'd rather you not. I can't consent to that." Unless of course I am the one doing the searching.

Ps also people say "I thought I would look guilty if I didn't let them search." Perhaps, but would you rather LOOK guilty while they have no evidence, or let them search and find evidence which PROVES you're guilty?

It's actually a pretty safe way to transport cash, many businesses deal in large cash transactions..........unless you have to worry about crooked cops stopping you and stealing your money.

If there is no evidence of a crime the police have no right to take anything. This is nothing more than theft by some thug in a uniform.

Like a cop in Ohio was caught texting a 15 year old girl as they exchanged nude photos. The kicker is he's a cop at her school. He got the felony reduced and 90 days suspended sentence and he does NOT have to register on the NSOR. - This type of exposure.

Now the interesting part is I know the crew building it and they have great funding and some very talented people working with them. BUT would took me by surprise was most of their leads come for other law enforcement officers.

......... and don't want to ramble on... but it much much more
The whole program needs a reboot. I have read your post, so I will not post anything incriminating on this subject or this board. When they are held responsible for their actions, they will be accountable. Sooner then later

You have yet to see one because they purposely leave those scenes out, just like you have yet to see anyone on cops run from the police and get away, or have never seen them search a car and come up with nothing. Cops is just a big propaganda machine for the cops.

Cops are tied with dentists as the top profession for suicide, and we need to keep it that way!
