I don't pretend to know anything about Canadian law, but in the US, this has been tried several times in the circuit courts and yes, it has been deemed free speech (especially since it is political speech)

As is the case with many general observations about free speech jurisprudence, the proper response to your point is "Yes, but...." ;-)

Glen is correct that passing a law requiring that the protest must be held at a distance removed from the service would hold up as Constitutional. The 2-mile threshold might be more than the Court would provide for, but laws requiring such protests to be out of sight of the funeral, and conducted either before or after the services have withstood court scrutiny, and will continue to, because the Government is allowed to impose "time, place and manner" restrictions on speech in certain conditions, if the court deems the balance of the competing interests in play to weigh in favor of such regulation.

In the recent case that Westboro triumphed in at the Supreme Court, the Phelps clan was sued for intentional infliction of emotional distress (among other claims), but since they had followed local laws when conducting the 'protest' in question, and there was no overt attempt to harm the plaintiff directly (in the eyes of the court, at least), the appellate court's overturning of the original jury verdict in favor of the plaintiff was upheld.

So.... yes; the courts have held what Westboro does to be free speech, but the courts also permit restrictions on how and where they express their vile point of view.

This is what I would do... I would find out who the leaders of their "religion" are, where their church is etc and I would turn the tables on them. I would do everything legally to harass them in the same manner but 10x without breaking the law. Use the same laws that give them rights to do this against them.

Use social media to organize others to help you, facebook, twitter. There has to be 1000's of people in your area that hate these fucks and feel the same way you do and you can organize to throw it back at them 24/7.

Don't break the law, but turn the tables and use it against them. Also don't organize against them at the funeral, if you get two sides yelling at each other that plays into their hands by giving them more media attention. One group of nuts protesting will get some media attention, two groups of people wanting to kill each other will get extra police out, and tons more media attention. As much as it hurts let them do their thing, ignore them then fucking throw it back it them 100x worst. Go to their homes, church etc with groups of people and protest their asses. You know 1/2 of them likely have sketchy pasts and criminal records, dig up the dirt, expose them for being hypocrites and make their lives miserable.

If they show up, try to find a veteran lawyer that will work pro bono for your family.
