I made this site this week. I am looking to gain traffic from the loop of how each page has multiple like buttons, bringing in more traffic than it sends out. Hopfully I can make this into a viral loop on Faceobok.

1) I don't expect the site to last long, since it does have the trademark name Facebook in the domain. It is the first experiment. If the concept works and the loop of likes-to-revisit ratio is good I may rebrand with a different genre or target:

There are many combinations I could go with: "The [Hottest/Cutest/Sexiest] [Girl/Guy/Chick/Babe/] [in/on] [the internet/Kansas/Denver/City/Craigslist]" etc etc.

Nice admission to registering the domain in bad faith with intent to infringe on facebooks marks and then actually infringing on their marks.

You've also handed them an easy argument for counterfeiting their marks which can include the domain alone, but which you (like a total moron), took further to include the very look and feel of the site and not simply the use of the word in a domain name... which then falls under civil R.I.C.O, meaning triple damages.

Without even getting their side, they've already got you for an easy 300K in damages for trademark infringement alone.

What you don't seem understand (predictably) is that you might not get a notice. You might end up just getting sued in Federal Court for a 6 figure or larger sum. You will walk up to your cardboard box and some weird dude will hand you a subpoena. Then you're fucked. Not responding to the lawsuit won't be an option, which means you'll need attorneys to respond or risk a default judgement against you for the full amount of the lawsuit.

It's a bit baffling that some of you tards just can't get the most obvious things sometimes.

You are wrong. They don't have to demonstrate anything. They are entitled to automatic statutory damages per instance of infringement. $100,000 max per instance. It has nothing to do with the value of the domain or site or sites income or money earned with the site. ZERO. They will then further allege that you are counterfeiting their marks, site etc and sue you under the civil RICO statutes and go for triple damages. Plus, they will allege all sorts of other damages and most likely try to recover legal costs. I could see this turning into an easy $400,000.00 USD claim.


Here is the KEY POINT.

They don't have the "prove" anything at all to force you into court fighting a costly legal fight. They simply have to make allegations. You have to show up and fight. It costs money to show up and fight. Lots of money.

Here is what you don't seem capable of grasping. It gets "proven" in a court of law and in front of a judge and jury. Them proving you did, you attempting to prove you didn't. You won't have the option to NOT defend yourself. No matter what, you have a real risk of being sued and being made an example of and you will most likely spend over $10,000 USD on legal fees just trying to come to a settlement. Not to mention if you are sued, you'll have to file a well worded response to the complaint which is easily going to run into the many $1000s just to avoid a default judgement against you.

You think every dude out there that registers something with "facebook" or any other trademark in the domain know's about the copyright/trademark? You will take the site down/hand over the domain. Are you just trying to scare the guy because he has a unique idea or what?

Yeah, when they register the domain, they usually know it infringes on the trademark. That's exactly why he registered this particular name to begin with... Thats why this whole project is resting on a foundation of illegal behavior to begin with, all of which is proven with his own admission in this very thread.

His reason for registering the domain was to capitalize on the name of a multi-billion dollar company, the popularity of their brand, their trademarks, the money they spend building their brand, the fact that the brand is instantly recognizable to surfers all over the world and they aggressively go after people who do that for good reason.

Why is that so hard to understand?

No one has to know a domain infringes on a trademark to be guilty of trademark infringement. Thats a pretty naive comment.

It is a simple fact - at a minimum, the use of that single domain is potentially $100,000.00 in maximum statutory damages to Facebook. Thats just what they are already entitled to under the law.

There are companies and individuals who have been sued for 8 figures, who made only tens of dollars or hundreds or thousands for doing nothing more than registering and parking trademarked domains.

You have to be a total idiot to not take something like this serious.

I've never used FB, and have no interest in it, but am I right in thinking if someone clicks "Like" then your website link appears on their FB page? Is that the "point" of it? If so, since every website seems to have a "Like" button, won't your site just be in a mass of other sites they've mindlessly "Liked"? Does it actually achieve anything?

It is probably like bookmarks; I don't use them unless I forget where the site was and
google works just fine anyway and so I still don't use them that often even when I forget.

That - alongside the domain - makes it look and feel to me like a phishing site. I'm not saying it is - though with a minor change it could be - but it sure feels like one when you expect to simply give someone a rating and it pops up asking for your FB login details.
