PHOENIX - One person has died following a shooting in the parking lot of a south Phoenix Taco Bell.

It happened about 7:45 p.m. Tuesday near 51st Ave and Baseline.

According to police, a male driver and female passenger were at the drive thru when their car was approached by a man carrying a metal pipe.

The man allegedly began banging on their car windows with the pipe, and the driver, fearing for his life, fired at the man.

At this point, police believe the shooting was self-defense, but the investigation is ongoing

Someone bashing out your windows with you in the vehicle, I would say it would be self defense as well.

I was driving through the bar district one night and some punk ass drunk frat boy thought it would be funny for him to run behind my car and he pounded his fists into the trunk, I slammed the car into park and jumped out and told him he was about to get his ass beat.. He immediately apologized and staggered off .. big difference in situations there...

New report that provides more information about the event:

LAVEEN - Police are saying more about a shooting at a Taco Bell Tuesday night in which one man died.

They're also identifying the victim as 29-year-old Daniel Adkins.

About 7:30 p.m., a 22-year-old man and his girlfriend ordered food at the Taco Bell drive-thru and were told to pull up while their order was prepared.

At the same time, Adkins stepped around a corner into the path of the vehicle and angry words were exchanged between he and the driver.

They got into an altercation and Adkins was shot once by the driver. He died at the scene.

The driver, a 22-year-old black male, called police but has not been arrested.

At first, the couple claimed that Adkins had a metal pipe that he swung at them -- but it turns out he was holding a dog leash with his yellow lab on the other end.

Family members want that driver arrested, but he's claiming self-defense.

"He needs to be behind bars. I'll never see my brother again," says sister Marina Reyes. "If he felt that my brother was threatening him, he could have easily just rolled up the window and called the cops."

A metal pipe or bat was never located. An independent witness did say Adkins swung his fists in the driver's direction.

“He swung his fist towards the driver window, and at some point the driver shot him,” says Phoenix Police Sgt. Tommy Thompson. “Just because we don’t book a person immediately does not mean we don’t charge a person at a later date.”

The dog, Lady, stayed by Adkins' side until the Humane Society came. Adkins lived with his mom and dad. He's 29, but his family says he's mentally disabled and has the mental capacity of a 12-year-old. He didn't drive, and walked wherever he went.

"This person is still on the loose and I don't agree with that. So he's saying self defense, then where's the weapon? Where's the pipe? They didn't find anything on my brother," says Reyes. "He was just too aggressive, you don't need to go that far."

The shooter's name has not been released. The investigation is still ongoing.

Thats the thing. If you were a pussy before you had a gun, youll be one with the gun. Lethal force was not necessary in this case, but given recent national and world events i could see why a person would quickly feel threatened. If the retard actually had the metal pipe it would open and shut case of self defense, but a man with a trained dog definitely doesn't sound all that scary no matter his actions.

when i was trying to park, some guy took the spot i was going for, i needed two drive a whole 6 more feet to get a spot.
i should have just shot him and claimed self defense...he was damaging my body by making me walk an extra 6 ft.

Pretty fucked up situation.

At first I was OK with the self defense thing but as the story evolves, it sounds like the driver/shooter was unjustified in his actions. If it's true that there was no pipe then it's time to charge him with murder. Cops accidentally shoot people under similar circumstances from time to time. "I thought I saw a weapon" is all it takes for them to walk free. If you're gonna shoot, you better be damn sure and not pull the trigger because you panicked.

Years ago a man got out of his car at an intersection and started beating my friends car with a wooden broom handle. My friend started yelling at me to shoot him or at least flash my gun. My response to my friend: "Ya know, you could just turn right and keep driving." My friend's mirror got busted up but none of us got killed, hurt, or went to jail that day.

not sure what state you live in, but in my state we have castle doctrine here which allows me to carry in my vehicle without permit.

however, many states are not that way and youd be arrested. here you can defend your "home" and family and that includes car with deadly force.

Although I agree that it seems the driver over reacted, the flip side of that argument is what if the guy was armed? You fire a "warning shot" which freaks him out so he pulls his gun and shoots you.

Just out of curiosity, what direction should a "warning shot" be fired while in a Taco Bell drive through?

The victims mental age of 12 was determined by doctors, while the shooters mental age of stupid idiot came from his own actions that day.
