This doesn't surprise me. I watched documentary a while back about innocent people convicted of major crimes. There have been some studies done that show as many as 85% of the people who witness a crime get at least some of the facts about what they saw wrong.

There are a lot of reasons for it, but in that study they showed multiple women who were raped and got a very good look at the rapists face could not pick the guy out of a lineup and people who saw a crime occur often got major details of what happened wrong. It was pretty interesting and scary.

He will be acquitted.

Sucks, as he killed that kid, but he won't get convicted of the charges against him. Chances are they will offer him a plea because their case is a terrible mess.

There have been multiple studies done over the years about eyewitness testimony and it has been proven to be unreliable and no one should be convicted based primarily upon eyewitness testimony...but they have been and still are. Basically if four people witness an event you will get four different accounts that are sometimes far different from one account to the other...and some times not one single thing will match from one account to another.

In the movie I watched there was one case where a woman in Philly got raped. The guy was white, had short brown hair and was average height and weight. She said he was wearing a red sweatshirt. It was fall, and the Phillies were good so half the town had red shirts of some kind on. They arrest a guy, she ID's him as the attacker. There is no physical evidence and he gets convicted. 12 years later they catch the guy who actually did it. He admitted it and even told the court they had the wrong guy. They actually had some fingerprints from the scene that matched this new guy so they knew he was telling the truth. He looked nothing like the original guy who was convicted.

The victim herself was shocked by how different they looked and couldn't believe she got it wrong because she remembers telling herself while it was happening to study his face so she could ID him later. Oddly enough she and the guy who was wrongly convicted ended up becoming friends and were working together to change some laws. In many states if you are wrongly accused of a crime you get no money when you are set free and they don't even expunge your record so it still shows you have been convicted of that crime.
