legal disclaim
hello!
![]() I'm about to launch my website the next week and the only thing I didnt think to do so far is the legal write. What I understand is that I need those 4 things. 1-Warning Page - Warns the viewer regarding adult content 2-Custodian of Records Statement - lists the location of the model releases 3-Terms & Conditions for Members. - Defines what members can and can't do. 4-Privacy Policy Statement - Becoming major issue on the net. Tells the viewer what you will do with their information. (this one I did it with a free online generator) so here come the question. Since all the warming page alway have the same text can I copy it from someone else or that could be see as a stealing act from other webmaster? Is there a way to give the Custodian information without all the planet been able to see my adresse on my website? Since I'm in canada I need that and the 2257 stuff on my site? (I have all the id and model release safe if I need them for some reason) And the privacy policy statement, should I hire a lawyer for it or it fine to take a generic one and do some modification so it fit my need? Thanks! ![]() |

You should contact a lawyer.

Since the above reply is useless, here's a bump.
FWIW, I doubt copying warning text is a big deal. Everyone else probably does it anyway; there's only so many ways you can warn people about adult material. Just copy a text and re-write it a bit. As for your 2257 contact address, I'm not sure if using a private mailbox is allowed, but some people do. For privacy, just get one only and amend it. Pretty sure there are sites that provide templates. Other people may have other opinions. |

Private mailbox is not allowed. It must be the real address where the records are held. The question is, why are you using your own information anyway? Why not use the 2257 information for which the information came from? Ie: The original producer.
That should solve that problem. If you leased the content from a broker, use the 2257 address he has on his site. That should more that satisfy the legal requirements. But in the end you are Canadian, not therefore really in need of following American laws which 2257 is. You have your own porn related laws to deal with. Just make sure you clearly state that all models who appear on your site are 18 years of age or older. And do your part to make sure that is a true statement. Then as I said before, just use the 2257 address given by the original producer.

What makes you think he's not the original producer?

I'm the original producer so it my adresse that should figure. But yes since we produce in canada I dont need to follow 2257 but I do it so it make my us customer feel more secure about the content.

Just 'be creative'. Like you say, it's not a Canadian law, and nobody is going to check anyway.
