French 75% income tax struck down by constitutional council

France's constitutional council has struck down a top income tax rate of 75% introduced by Socialist President Francois Hollande.

Raising taxes for those earning more than 1m euros (£817,400) has been a flagship policy for Mr Hollande.

The policy angered France's business community and prompted some wealthy citizens to say they would emigrate.

Mr Hollande's government said it would rework the tax, due to take effect in 2013, to meet the council's complaints.

In its ruling on Saturday, the Constitutional Council said the new tax rate "failed to recognise equality before public burdens" because, unlike other forms of income tax, it was to be applied to individuals rather than households.

For example, that meant a household in which one person earned more than 1m euros would pay the tax, but a household in which two people earned 900,000 euros each would not have to pay.

The council also rejected new methods for calculating the tax.
Pressing ahead

But Prime Minister Jean-Marc Ayrault said the government would press ahead with the new tax rate.

"The government will propose a new system that conforms with the principles laid down by the decision of the Constitutional Council," he said.

The new rate was seen as largely symbolic since it would have only applied to some 1,500 people for a temporary period of two years.

But along with other tax rises, it has still been the subject of fierce debate in France.

French actor Gerard Depardieu recently announced he was moving to Belgium to avoid taxes, sparking a furious reaction from some on the left.

There was also speculation that people employed in high-income jobs like banking and finance would move elsewhere, including to London.

Mr Hollande campaigned against the austerity policies used in many European countries affected by economic crisis, favouring higher taxes rather than spending cuts to bring down the deficit.

The 75% rate for high earners was included in the government's 2013 budget, approved by parliament in September."

Don't know how it works in France, but emigrating doesn't help a US citizen - you're still on the hook for federal taxes no what where you live or where you make it. And it's illegal to give up your US citizenship in order to avoid paying federal taxes - as many are trying to do now.

Lowering taxes when people want lower taxes could be the correct strategy. Too high taxes could slow down business activities. Tax rate of 75% is one of the highest tax rates I ever heard about. Everything just has to be obsessed about richness and rich people. Some people might want to reach the rich level, but maybe they have not reached that level completely, yet. It really is possible to grow your savings, however wrong purchases have to be minimized. Frog in hat is funny.

The toll for the major bridge here was put in effect to pay for it and was supposed to expire once it did. That would have been decades ago...

If you're renouncing for the purpose of avoiding taxes, the IRS can still tax you for up to 10 years from the day you are no longer a citizen. No idea how they could collect it, but that's what they claim.

If that is not a form labor slavery I don't know what is.

It really is. They at least give us a nice tax break if we live abroad. They raise it a little every year, 2013 will be $97,600 we can earn tax free. Anything over that we have to pay on. If you make under that you don't pay any taxes.

So am I, and they raised mine too, but I'm not complaining, because even with all the social massive contributions, I'm still paying less (ie taking home more) than I would in the UK on my tax return.

And fwiw, this 75% rate is on anything earned *over* 1 million - it's a tax bracket, not 75% on everything. And it's only valid 2 yrs. Before it was 60% if I'm not mistaken, so a big increase, but not huge.

I've nothing against it myself, as I'll never earn a million a year. And if I earned 1.2m a year, to pay an extra 30k in taxes more than the other govt (which is what this amounts to) wouldn't bother me Taken as "75% tax on 1million" is drama, when in fact it's pennies.

work out how much of your money really goes to the government and you will get a better perspective...its no just the tax...you give them money every time you buy something in the shop or pay for a service...absolutely every monetary transaction is taxed...in reality the gov takes 80+% of everything you make...work it out and see for yourself

Surrendering US Citizenship is possible. Current IRS guidelines establish a one time exit tax/fee of 15% of your total net worth. It doesnt get you off the hook for past taxes owed, but you can certainly take proactive steps to reduce your tax liability in the upcoming years.

You mistaking me for Baddog? When I first started working at 16 I think it was under 30%. When I moved away and went to school I had to pay for my own school. Gov would not give me any assistance, and I tried to get it. I grew up in the country so our roads were always dodgy. No complaints. But people who pay more than 1/2 of their income to the government are idiots, be it my grandfather or his grandfather. It's not like they are getting free health care and insurance for their contribution.

Though, I can understand back in the old days when most people were patriots and wanted to go to war to fight for "freedom." Back then people were easily duped. That doesn't make them any less of an idiot, but it makes a little more sense. I'm sure it was incredibly easy to propagandize people back then.

It is no wonder people evade taxes and hide money offshore. Good for them. Hopefully most who renounce put in the time and work to prepare for such a thing so the IRS ends up getting 15% of not much. Then again, what's 15% when you'll never have to pay those cock suckers again? Perhaps I'd pay the 15% with a smile and send them Christmas cards every year after with a picture of my balls attached.

The article is propoganda because the English do not want similar laws being passed in their nation.

The fact is that the majority of the French want this taxation of the rich. However since Sarkozy's presidency there has been a lot of power given to a hand full wealthy people.

The new tax laws will pass and I applaud the new president for his efforts.
