No, you don't. You can email market ANYONE you wish. That's why many people refer it to the CAN spam act.

We used to do this with escorts who abandoned during the ad building process. They got really creeped out when we contacted them a few days later so we had to abandon it.

You obviously know nothing about the CAN-SPAM act and compliance. Or you're just trolling for effect and giving people bad advice. Which, considering your own post history, is probably more so the case. Before you can start sending someone email, they need to DOUBLE OPT-IN to accept your marketing messages per CAN-SPAM (assuming you're located in the U.S.). Single OPT-IN's do not count as CAN-SPAM compliant.
