They have some fun and creative marketing emails. I do not think this should be labeled as SPAM at all tho. ;)

I'm not sure, but that may not be spam per se in a legal sense. Unless they hammer you with it again and again. Isn't it a cold call to a potential affiliate? I'm asking.

I got the email too, and I had never heard of them. However, I am signed up for thousands of email lists because I run YNOT Mail, if only for testing purposes, so it's not common for me. Mine had a unsubscribe link.

When is spam not spam? When Jman says it isn't.

its too difficult to classify an email as "not spam" so easily and frequency does not really come into the definition...its unwanted bulk email - email that was triggered not based on some sort of permission and email deemed less relevant to the individual receiving it. The only person that can really say its spam or not is the individual getting it.

even a system where someone registers, acknowledges registration and verifies their email address..email sent to them can become more and more irrelevant/ less targeted over time

some of the most basic regulations on email best practices say you need that unsub link along with other standard footer stuff...there needs to be a way to remove yourself at any time...the second folks cant do that its a problem

Lets say I look at this thread right now and decide that three people might want to join my service. I am allowed to email them. I'm also allowed to hit them up on ICQ or Skype or whatever other way they offer as contact.. a private message etc. That's not spam, because spam has a legal definition. It's also not subscribed, so there is no possible way to include an unsubscribe link. It's just a technicality over the use of the word. Unwanted is unwanted, but all unwanted is not able to be considered spam since that has a definition.

Despite its name, the CAN-SPAM Act doesn?t apply just to bulk email. It covers all commercial messages, which the law defines as ?any electronic mail message the primary purpose of which is the commercial advertisement or promotion of a commercial product or service,? including email that promotes content on commercial websites. The law makes no exception for business-to-business email. That means all email ? for example, a message to former customers announcing a new product line ? must comply with the law.

In other words, the recipient had to have subscribed (opted in)

Well that's ok,but if you start repeating sending mails despise person stated how he does not have interest to receive them, then it's spam.

Is it commercial?
Is it unsolicited?
Is it email?

Tick those three boxes, as this mail does, and it absolutely, unarguably is spam. It is the dictionary definition.

Well, you quoted from here or similar: http://www.business.ftc.gov/document...guide-business
but then added your own "in other words" which I do not believe is accurate at all, but is widely believed. You're kind of saying that receiving any email from any company is spam. UNLESS you told them it's OK. Wouldn't that be great? But it's not so..

I believe that email is can-spam compliant and have no problem whatsoever if I'm wrong. I suggest the OP avail himself of the numerous contact methods that the email contains, or any other found on the website and after providing his email address ask them to please not contact him or he will consider it spam and take action.

Utter fucking gash.

You are totally legally allowed to email ex customers without them opting into anything.

Stick to taking out of focus bad pictures, you suck at email marketing advice.

Yeah I agree. If he gets a second one, then all bets are off I think. I think the word spam is just tossed out there for anything we didn't ask for when it's really not the case. I stopped email marketing before 2004 because I didn't feel like including my home phone number and address on them.

That's true too. If you have an existing business relationship with an entity, it can email, call, snail mail you all day long. Which SUCKS because almost every week I get ads from Verizon because they're my phone carrier.

Too much time on this thread, heh. Have fun all.

Don't leave so quick; you are the one that pointed out I quoted the FTC. Past customers are not existing customers.

And since someone quoted Damian . . . read the link, I did not make it up. TBH, I was surprised too. http://www.business.ftc.gov/document...guide-business

It's additionally breaking the law by not having a physical address on the email.

This shit isn't hard.

- have a working unsub
- put an address
- don't email people you've not had a relationship with or who haven't asked you to mail them

sigh

LMAO at some of you guys who will gladly enjoy FREE drinks at a show SPONSORED by a kickass company who sent an email to someone actually in this biz.

Whiny and Hypocrite is the plague now in this industry.

I DARE to ANY of you to go school the people at bitter while you have one of their drinks in their hands. Baddog you'd be the FIRST to take their money if they would sponsor to pay for your trip to Amsterdam.

Man this place is starting to suck ...

AND IN MY BOOK can-spam act, law or not. These guys aren't spammers.

Now here's a tissue for all of you... and good night.

RE: Bitter Strawberry Spam!! How Do I Stop It???

Hey..

I'm the author of the email, here are my comments:

1st. I got the list with the email addresses about 1 month ago, which contained over 400k email addresses, "supposed" to contain email addresses of adult tube site owners.

2nd. The reason for which @LeRoy, you did not see an unsubscribe e-mail is because this was not a Newsletter.. it is regular e-mail.
BitterStrawberry newsletters come in a different form, with an unsubscribe link.

3rd. I did receive your emails:

On Aug 15, 2013, at 7:37 PM, LeRoy Rowland <[email protected]> wrote:

Can you remove this email from your list?

All of your lists please

Thanks,
LeRoy

and the second one:

On Aug 15, 2013, at 7:37 PM, [email protected] wrote:

Thanks,
LeRoy

If you would be spammed you would have received over 10-15 emails, which you of course did not.
So relax, you won't be disturbed anymore.

Such a big discussion...

Have a good day everyone!
Cheers!

Oh dear, so not only are you sending unsolicited commercial emails (spam) with no unsub, no address and nothing approaching legal compliance, you BOUGHT a list from someone and spammed it?

You're the new WTFBucks. Congrats on not having a clue about email marketing.

All that says it that B2B must comply with the law. I can see nothing there about your claim you cannot email ex customers unless they have opted in. Because, AFAIK, it's nonsense.

@Damian...

The list was supposed to have " email addresses of adult tube site owners interested in adult sponsors".
Once again, It is not a newsletter, if you want i can translate in other languages ;)
As you see above, regular newsletters look differently ;)

And let me ask you this, if you were looking for business, what is your suggestion? that i send you an email first and ask you if I can send you a 2nd email detailing who I am and what i want from you?

Honestly... it's just plain stupid.
I admit that i should have manually checked the few 100 emails i eventually ended up sending email to, but it seems to me that you are over-exaggerating on a topic that should have not been written anyway in the first place.

As i specified in my 1st post, I did see the emails from LeRoy, and will not send him email anymore.

Now.. you have any other comments?

Hello, whether it's a spam or scam if you don't like them sending you email you can just block the email address. Please see instruction here http://email.about.com/od/gmailtips/...ock_sender.htm

I hope it helps

Cool. It's illegal to email people on a bought list.

Doesn't matter what you call it. It is unsolicited, commercial email.

They shouldn't. Any email communication needs to have working unsub and your physical address on. And you shouldn't send to bought lists.

Anything other than spamming people who haven't asked to hear from you.

If you want to email people, you need to get them to opt in to receiving email from you. If you want me to help you do that, PM me. My fees are reasonable.

It's a VERY important topic. You've now learned you are breaking the law and what you need to do if you want to send emails.

Good. But you really need to totally rethink your email marketing strategy to be legal and, well, good.

Pleasure. The email itself is pretty bad too. Sounds like every email I get from people wanting to sell me something.

Better would be to follow this sort of thinking:

Do you make as much as possible from your mobile traffic?

Sure?

Do you get as much as $x from tier one countries?

I can make that happen for you and would love 5 mins of your time to discuss how I can help you make more money.

or

Would you like to make more money from your mobile traffic?

or

Our top 10 clients made $x last month from their mobile traffic. Would you like to make more money too?

Etc...

In short, you ask them a question they HAVE to say yes to. That will get them to read more of the email.

Better than "I came accross your website and I'd like to find out more about you" which I translate to "Hi this is spam and I am going to try and sell you something". It's also important to get a native English speaker to correct the mistakes you make in the email.

Hope that makes sense.

Sorry but both sound equally spammy to me

What they should do is focus on who they really want on board and try a more personal approach. Be pro-active on what you want, come up with suggestions, etc. Don't be lazy and just spam a list with the same message.

Just my 2 cents ;)

No need to say sorry!

Just the essence of the point was to ask a question or solve a problem people have in the first sentence to get people to read on.

But yes, contacting people personally is the right answer.

Can you remove this email from your list?

All of your lists please

Thanks,

and the second one:

If you would be spammed you would have received over 10-15 emails, which you of course did not.
So relax, you won't be disturbed anymore.

Such a big discussion...

Have a good day everyone!
Cheers!
Thanks

I'm in sales too so I dont mind an occasional email from the show. I clicked the unsubscribe link on the 1st email. When I got the second and there wasnt an unsubscribe link I thought hmmmm.

So I posted here

LMAO AGAIN with the language jab. As I told you once, when you can speak as good french as I speak english.... THEN come and school me.

Also you clearly understood my comment about you.

I am sure the guys at ICM aka.XXX had quite the giggles when they wrote you a check to stamp their logo on your pics.

With that said why don't you post pics of what you did last weekend and make sure to hit not only GFY but ALL the webmasters facebook groups so we can have the privilege of seeing those SAME posts 3-4 time

If someone writes something in French that I do not understand I contact one of my French friends if Google translate isn't clear. Why don't you try that, then come back and show me where I said ANYTHING about Bitter Strawberry. All I addressed is the legalities of spam.

While you are at it, why not show us an example of my posting photos on a webmaster facebook page.

I'll take spam like this 100x before all the very cold and useless FHG dumps I get from all those programs... but thats just me .

Of course, you should not mass mail people from bought list. It will always backfire.
If you want to do unsollicited cold call, try to do them one by one. You'll have more results and less bitter people.

Anyway Bitterstrawberry make me tons of cash and make me smile everytime I get those emails.
