Getting burned always sucks. But posting this thread was a very bad idea. You just admitted to a possible crime, possible defamation, possible damages.. and all he's gotta do is google his domain and this thread will pop up.

The professional way to handle it would have been small claims court.. or whatever they have in your jurisdiction.

2 months later from being ignored, I deleted the work I did.

Its not defamatory if its true. The OP is in Spain so obviously his options are limited. May or may not be the right way to go about things but I can't say I blame him.

In your example the roofer has the right to come and remove everything you have failed to pay for. If that leaves you with a big hole in the roof that lets in water that is your fault for not paying.

The roofer also has the ability to easily place a lien on the property. Which is what they would most likely do, and which does happen.

The roofer does not have the right to come on to private property and do anything at all without the permission and consent of the property owner.

Does the OP know if it's true or not? I think it said something like "So and so doesn't pay his designers" - which may, or may not be true. If the client ever paid a single designer (just not the OP) it's potentially defamation.

I made a mental note of the OP's location when I made my statement.

Of course not getting paid sucks. But there's a professional way to handle it, and a childish way to handle it.

Obviously people learn from mistakes, so hopefully you come away with this, with some knowledge in the future about doing business.

As I'm sure you now regret posting this, it's to late. Even if it's deleted, you publicly made it known your intentions and what has been done. There is nothing you can do about that, so now you need to think about the road ahead.

Seems like you left yourself vulnerable to be ripped off, even with bullet proof contracts, someone will find a way not to pay you. Take this as a lesson learned and add in clauses to your contracts, such as a valid credit card on file, their Tax ID (if in the US) or some payment protection on your end -- collections, etc.

The crime you committed is NOT related to what he did for not paying you, unless that is within your contract. Two wrongs don't make a right, but what you did was admit you did something without permission. If I was to pay you to come in my house to change a light bulb, then didn't pay you, that doesn't give you the right to come back and take what you feel is necessary for payment. Regardless, you committed a crime no matter how you look at it.

For a reference point, I have a lot of experience with business law, and criminal and civil litigation; but I'm trying to help you here.

First, UNDO what you did on his site, upload it back and walk away.

Then, send him/her a certified letter, NOT email so you have proof and tell them they have X days to pay or you will send this to collections, including policing agencies as you feel that he/she have committed fraud and stolen from you. If they are a legit company, you can find their Tax ID, include that as you can file a complaint against it, including for tax purposes.

The goal would be to settle here, not to get 100%. Tell them if they pay X%, you will mark the debt as paid, as well request a release to be signed so this doesn't come back to haunt you later.

The best thing to do is to always charge a deposit for your work and then work out a time-table for deliverables and payments. So for example if you estimate it will take 6 weeks to build a site and you both agree to the time frame, ask for 33%-50% down before you start any work. Then 2 weeks later show him the update and ask for another payment. 2 Weeks after that, show updates and ask for payment again, etc.

This way you both get what you expect.
