Los Angeles police officers tampered with voice recording equipment in dozens of patrol cars in an effort to avoid being monitored while on duty, according to records and interviews.

An inspection by Los Angeles Police Department investigators found about half of the estimated 80 cars in one South L.A. patrol division were missing antennas, which help capture what officers say in the field. The antennas in at least 10 more cars in nearby divisions had also been removed.

LAPD Chief Charlie Beck and other top officials learned of the problem last summer but chose not to investigate which officers were responsible. Rather, the officials issued warnings against continued meddling and put checks in place to account for antennas at the start and end of each patrol shift.

Members of the Police Commission, which oversees the department, were not briefed about the problem until months later. In interviews with The Times, some commissioners said they were alarmed by the officers' attempts to conceal what occurred in the field, as well as the failure of department officials to come forward when the problem first came to light.

The cameras, which turn on automatically whenever an officer activates the car's emergency lights and sirens or can be activated manually, are used to record traffic stops and other encounters that occur in front of the vehicle. Officers also wear small transmitters on their belts that relay their voices back to the antennas in the patrol car. Regardless of whether they are in front of the camera, officers' voices can be recorded hundreds of yards away from the car, said Sgt. Dan Gomez, a department expert on the recording devices.

The distance an officer can roam and still be recorded depends on what buildings and other objects are interfering with the signal. Removing an antenna does not render the voice recorder useless but cuts its range by as much as a third, Gomez said, citing information from the manufacturer.

Most of the antennas were removed from cars in the Southeast Division, which covers Watts, Jordan Downs and Nickerson Gardens, where relations between police and minority communities have historically been marred by mistrust and claims of officer abuse. The in-car video cameras have been touted as a powerful deterrent to police misconduct and a tool for defending officers against false accusations.

A federal judge last year formally ended more than a decade of close monitoring of the LAPD by the U.S. Department of Justice. The judge agreed to lift the oversight, in part, after city and police leaders made assurances that the LAPD had adequate safeguards, such as the cameras, in place to monitor itself.

The first sign of a problem came in early July when a Southeast supervisor noticed the cameras in a few patrol cars were missing antennas, said Cmdr. Andrew Smith, a spokesman for Beck. Vehicles are equipped with two small antennas, one for each of the officers assigned to the car.

After the supervisor's discovery, a check of the entire fleet of cars in Southeast and the other divisions in the department's South Bureau was done. With a total of about 160 antennas installed in Southeast Division vehicles, 72 had been removed, Smith said. Twenty antennas from cars in other divisions were missing as well.

Black Man Sentenced To Death By All-White Jury Freed After 30 Years

Glenn Ford was Louisiana?s longest-serving death row inmate until Tuesday, when he walked free after 30 years behind bars in a notorious maximum security prison. For three decades, he had maintained he didn?t commit the murder of which he was accused and wasn?t present at the time it occurred.
Ford, an African American man, first became a suspect in the murder of Isadore Rozeman, a jeweler and watchmaker for whom Ford occasionally did some yard work, when the girlfriend of a fellow suspect implicated Ford in the murder. Later testifying at his trial, she stated that she ?lied about all of it.?
Ford was nonetheless convicted and sentenced to death by an all-white jury on testimony that the shooter was probably left-handed, that there were traces of gun powder particles on his hands, and that fingerprints found on a bag at the scene had more in common with Ford than two alternative suspects, according to the Capital Post Conviction Project of Louisiana. There were no witnesses to the alleged crime, and no weapon found. His two court-appointed lawyers had almost no experience with jury trials or criminal cases, let alone capital cases in which the defendant?s life was on the line. And even though a court later reviewing the conviction agreed that prosecutors had withheld evidence favorable to Ford, it declined to grant him a new trial, reasoning that this evidence would not have made the difference.
What finally changed the prosecutors? position was a confession by another man who had been a suspect all along that he shot and killed Rozeman, given to the state by a confidential informant from a county police department, according to the Capital Post Conviction Project. The state cited only new ?credible evidence.?
?I?ve been locked up almost 30 years for something I didn?t do,? Ford said. ?I can?t go back and do anything I should have been doing when I was 35, 38, 40, stuff like that.? He added that his kids were babies when he was hauled off to prison, and those kids now have their own babies.
Ford?s exoneration brings the tally of death row inmates cleared of all charges to 144 nationally and 10 in Louisiana since 1973 (when the U.S. Supreme Court imposed a moratorium on the death penalty and then lifted it three years later), according to the Death Penalty Information Center. Last October, a man was released just days before his death, also from Louisiana?s Angola prison, after spending decades in solitary confinement for a false conviction in a racially charged murder case.

NEW YORK (AP) ? From the day of his 1989 arrest in a deadly New York City shooting, Jonathan Fleming said he had been more than 1,000 miles away, on a vacation at Disney World. Despite having documents to back him up, he was convicted of murder.

Prosecutors now agree with him, and Fleming left a Brooklyn court as a free man Tuesday after spending nearly a quarter-century behind bars.

Fleming, now 51, tearfully hugged his lawyers as relatives cheered, "Thank you, God!" after a judge dismissed the case. A key witness had recanted, newly found witnesses implicated someone else and prosecutors' review of authorities' files turned up documents supporting Fleming's alibi.

"After 25 years, come hug your mother," Patricia Fleming said, and her only child did.

"I feel wonderful," he said afterward. "I've always had faith. I knew that this day would come someday."

The exoneration, first reported by the Daily News, comes amid scrutiny of Brooklyn prosecutors' process for reviewing questionable convictions, scrutiny that comes partly from the new district attorney, Kenneth Thompson. He said in a statement that after a monthslong review, he decided to drop the case against Fleming because of "key alibi facts that place Fleming in Florida at the time of the murder."

From the start, Fleming told authorities he had been in Orlando when a friend, Darryl "Black" Rush, was shot to death in Brooklyn early on Aug. 15, 1989. Authorities suggested the shooting was motivated by a dispute over money.

Fleming had plane tickets, videos and postcards from his trip, said his lawyers, Anthony Mayol and Taylor Koss. But prosecutors at the time suggested he could have made a quick round-trip plane jaunt to be in New York, and a woman testified that she had seen him shoot Rush. He was sentenced to 25 years to life in prison and was due to have his first parole hearing soon.

The witness recanted her testimony soon after Fleming's 1990 conviction, saying she had lied so police would cut her loose for an unrelated arrest, but Fleming lost his appeals.

The defense asked the district attorney's office to review the case last year.

Defense investigators found previously untapped witnesses who pointed to someone else as the gunman, the attorneys said, declining to give the witnesses' or potential suspect's names before prosecutors look into them. The district attorney's office declined to comment on its investigative plans.

Prosecutors' review produced a hotel receipt that Fleming paid in Florida about five hours before the shooting ? a document that police evidently had found in Fleming's pocket when they arrested him. Prosecutors also found an October 1989 Orlando police letter to New York detectives, saying some employees at an Orlando hotel had told investigators they remembered Fleming.

Neither the receipt nor the police letter had been provided to Fleming's initial defense lawyer, despite rules that generally require investigators to turn over possibly exculpatory material.

Patricia Fleming, 71, was with her son in Orlando at the time of the crime and testified at his trial.

The Tuskegee syphilis experiment (/tʌsˈkiːɡiː/)[1] was an infamous clinical study conducted between 1932 and 1972 by the U.S. Public Health Service to study the natural progression of untreated syphilis in rural African American men who thought they were receiving free health care from the U.S. government.[1]

The Public Health Service started working with the Tuskegee Institute in 1932. Investigators enrolled in the study a total of 600 impoverished sharecroppers from Macon County, Alabama. 399 of those men had previously contracted syphilis before the study began, and 201[2] did not have the disease. The men were given free medical care, meals, and free burial insurance, for participating in the study. They were never told they had syphilis, nor were they ever treated for it. According to the Centers for Disease Control, the men were told they were being treated for "bad blood", a local term for various illnesses that include syphilis, anemia, and fatigue.

The 40-year study was controversial for reasons related to ethical standards, primarily because researchers knowingly failed to treat patients appropriately after the 1940s validation of penicillin as an effective cure for the disease they were studying. Revelation of study failures by a whistleblower led to major changes in U.S. law and regulation on the protection of participants in clinical studies. Now studies require informed consent (though foreign consent procedures can be substituted which offer similar protections; such substitutions must be submitted to the Federal Register unless statute or Executive Order require otherwise),[3] communication of diagnosis, and accurate reporting of test results.[4]

White Americans are more likely than black Americans to have used most kinds of illegal drugs, including cocaine, marijuana and LSD. Yet blacks are far more likely to go to prison for drug offenses.

This discrepancy forms the backdrop of a new legislative proposal in California, which aims to reduce the disproportionate incarceration of black people in the state. Supporters of the bill, SB 649, point to some striking national data.

Nearly 20 percent of whites have used cocaine, compared with 10 percent of blacks and Latinos, according to a 2011 survey from the Substance Abuse and Mental Health Services Administration -- the most recent data available.


Higher percentages of whites have also tried hallucinogens, marijuana, pain relievers like OxyContin, and stimulants like methamphetamine, according to the survey. Crack is more popular among blacks than whites, but not by much.

Still, blacks are arrested for drug possession more than three times as often as whites, according to a 2009 report from the advocacy group Human Rights Watch.

Of the 225,242 people who were serving time in state prisons for drug offenses in 2011, blacks made up 45 percent and whites comprised just 30 percent, according to the Bureau of Justice Statistics.

Jamie Fellner, author of the Human Rights Watch report, offered an explanation for this discrepancy.

"The race issue isn't just that the judge is going, 'Oh, black man, I'm gonna sentence you higher,'" she said. "The police go into low-income minority neighborhoods and that's where they make most of their drug arrests. If they arrest you, now you have a 'prior,' so if you plead or get arrested again, you're gonna have a higher sentence. There's a kind of cumulative effect."

Lawmakers in California hope to blunt that effect. Last week, both houses of the state legislature passed SB 649, which would give judges and prosecutors the option of charging people convicted of drug offenses with misdemeanors instead of felonies. Those offenders could then be sent to substance abuse treatment centers instead of prison or jail.

Supporters of the bill, including its author, state Sen. Mark Leno (D-San Francisco), note that black adults represent one-quarter of all felony drug arrests in California, despite comprising just 5 percent of the state population.

"One can take it to conspiratorial or racist theories or not," Leno told HuffPost. "The motivation I don't think needs to be determined. The results are the same: Our policy and lawmaking perpetuate a chronic underclass of citizens."

Former prisoners who were convicted of felonies often face steep official barriers to "the very things that are needed to keep one successful in recovery," he added -- namely, education, housing and employment.

The federal government can deny public housing assistance to anyone who has been convicted of a felony drug offense. Students who have been convicted of drug possession are barred from receiving federal financial aid and substantial education tax credits. And employers often require applicants to disclose their criminal histories, despite a growing nationwide movement to ban that practice.

Not all drug offenses in California automatically result in felony charges. Methamphetamine, LSD and certain other drugs are known as "wobblers," meaning that possession of those drugs can be charged as a felony or a misdemeanor. The new bill would basically extend this "wobbler" approach to heroin, cocaine and most other drugs. Blacks use heroin and cocaine more than they use meth and LSD, which are primarily used by whites.

In recent years, states from New York to Texas have adopted reforms that resemble SB 649, and leaders across the political spectrum have pushed for changes to the country's drug sentencing policies. In August, Attorney General Eric Holder announced that the Justice Department would no longer pursue mandatory minimum sentences for certain low-level drug offenders, citing "shameful" racial disparities in the criminal justice system.

Yet some drug reform advocates worry that Gov. Jerry Brown (D) might not sign the California measure, noting that he has often seemed reluctant to embrace progressive criminal justice policies.

Like other reforms aimed at reducing California's prison population, SB 649 could help relieve the state's budgetary woes, supporters say. Drug sentencing policies are widely blamed for the enormous size and costs of the country's prison systems. And few prison systems are bigger or more expensive than California's.

At the height of America?s war on drugs, from the 1980s through the mid-2000s, more than 20 prisons opened in California, compared with just 12 between 1852 and 1984. California?s prison population increased more than fivefold in the later decades, and prisons now cost the state's taxpayers close to $10 billion a year.

Regardless of whether they are in front of the camera, officers' voices can be recorded hundreds of yards away from the car, said Sgt. Dan Gomez, a department expert on the recording devices.

The distance an officer can roam and still be recorded depends on what buildings and other objects are interfering with the signal. Removing an antenna does not render the voice recorder useless but cuts its range by as much as a third, Gomez said, citing information from the manufacturer.

Most of the antennas were removed from cars in the Southeast Division, which covers Watts, Jordan Downs and Nickerson Gardens, where relations between police and minority communities have historically been marred by mistrust and claims of officer abuse. The in-car video cameras have been touted as a powerful deterrent to police misconduct and a tool for defending officers against false accusations.

A federal judge last year formally ended more than a decade of close monitoring of the LAPD by the U.S. Department of Justice. The judge agreed to lift the oversight, in part, after city and police leaders made assurances that the LAPD had adequate safeguards, such as the cameras, in place to monitor itself.

The first sign of a problem came in early July when a Southeast supervisor noticed the cameras in a few patrol cars were missing antennas, said Cmdr. Andrew Smith, a spokesman for Beck. Vehicles are equipped with two small antennas, one for each of the officers assigned to the car.

After the supervisor's discovery, a check of the entire fleet of cars in Southeast and the other divisions in the department's South Bureau was done. With a total of about 160 antennas installed in Southeast Division vehicles, 72 had been removed, Smith said. Twenty antennas from cars in other divisions were missing as well.

So my question was perfectly normal and justified - does that study keep that in mind or does they just twist the conclusions to fit the agenda?

On top of that - courts pay attention to other details about defendants life situation, for example if one has a job or goes to college, or does nothing. If he/she does than he/she might expect better sentencing. And statistically whites do that more often. So naturally that concludes to lesser sentences on average.

It has nothing to do with the color as you foolishly claim.
