What am I allowed to do with affiliate content?

Hello everyone!

I'm new to the industry and like to build a tube site. Most affiliate programs appear to offer free hosted galleries which a very convenient as you don't have to buy webspace yourself. However, what am I allowed to do with the content? Specifically, is it okay to use individual videos from a gallery and present them in a different manner (hence a tube site)? Sorry for the stupid question, but some affiliates explicitly offer "embedded videos".

The broadest, general interpretation of acceptable use would be to use that content ''in good faith'' to promote that program.

Each individual affiliate program has its own AUP and TOS policies and their interpretation of that policy. You should read that program's Affiliate Agreement (contract), AUP and TOS. Then if you are still unsure of allowed use -- ask that program's affiliate manager or other program personnel.

There is no central authority to ask.

I did. But some terms are very restrictive and make no sense for an affiliate program.

Nastydollar for example: "No Promo Materials may be copied, reproduced, altered, modified, changed, broadcast, distributed, transmitted, disseminated, sold or offered for sale in anymanner except as expressly authorized in writing by NastyDollars."

Publishing on a website is "reproduction", "broadcasting", "distribution" and "transmittion" in my understanding.

Sapphiccash: "...shall not modify... file names... or other material for any purpose whatsoever."

Obviously I can't speak for other affiliate program owners, but as a former affiliate program owner, we seldom monitored what our original promo content was used for. And the few times I'd google search the stuff, 99% of the time the content had our backlinks in place and was driving us traffic.

Provide backlinks and don't chop off watermarks and you should be fine...as long as you don't put the affiliate content alongside questionable or illegal content - or cast it in a negative/derrogatory way.
