Did you not read the part about legit affiliates having models later down the road send DMCA's because of regret? Do you think that people should be sent to jail for that too or are you just painting a broad brush on everyone and assuming because someone got a DMCA, they automatically stole it?

so far just barely plausible story has been posted... no name of model involved, no name of lawyer, no name of affiliate program he got the content from, etc...

How hard would it be to post the following?
"look guys, I got content of xxxx model from xxxxx.com affiliate program, now she apparently found god and hired this xxxx lawyer that is harassing me"

everyone would then stfu, the discussion would get directed towards the model... someone would post a pic of her getting gangbanged... we would all have a good laugh... and that would be it...

Again, it's very simple. He has two options here. He either takes down the content and walks away from it, or he spends the next six months and potential legal fees (have to involve an attorney at some point) trying to determine who legally owns the rights to a picture or video. It's just not worth it. It's not that anyone has done anything wrong, it's just that an affiliate has no way to verify or prove who owns a picture and it's not worth it.

Best case scenario the affiliate contacts the program, and if they are lucky the program responds with a model release form that proves.... Almost nothing. A model release form proves that someone shot the model and has rights to use pictures or video, but you aren't sure for which pictures or which videos, most likely the content owner is the photographer and not the program itself, and you don't know if these rights have been resold or given to someone else.

It's just not worth the effort to fight such things.

Yes I did...the operating quote I have used is: "I have been DMCA'd 100 x"... I doubt that there were 100's of models who found God all of the sudden, and webmasters??? If they are NOT thieves and own the content legally then even a God cannot enable some Model's lawyer to go after anybody... But if you deal with thieves or other shady characters... Or steal stuff directly then you deserve what you get. A nasty lawsuit.

And one more piece of advice...these lawyers will never take it to court ( and I know I have a two of them) but they will file a complaint and the person's real name and a domicile address becomes a public record and then just a phone call to some local reporter will cause the following headline in the local paper: "Mr. XYZ known as a boy scout leader a soccer coach and a member of Our Lady of Roses baptist church has been named as posessing and distributing pornography "..... Sometime worse then paying a couple grand to a skunky lawyer ( formerly known as ambulance chasers)

... But that is not my call

why should he? to satisfy gfy's bored mob? he's already stated it's a UGC site (which he didn't need to), pretty simple. There's a ton of reasons legit sites get dmca's, I've had a ton myself over the years, normally over-zealous 3rd parties... easier to just take the content down and fuck the sponsor off as a bad ROI. If I came here and asked the same questions, and had a bunch of gfy armchair lawyers questioning me all they'd get back is a 'fuck off', so jscott has been extremely reasonable in this thread

half the avatars on this site are stolen, I know mine is. gfy should close down because they are 'thieves'? Think that facebook thread here is full of paid/licenced content? This and every forum in existence has tons of copyrighted content on it... that doesn't make the owners thieves - big difference between a forum/ugc site geared towards theft, and one that gets dmca'd... one does not necessarily mean the other, as I'm pretty sure you already know - you aren't one of the clueless
