That's all that might happen. If he needs his credit in the future, just explain the story of why it's showing up at the time and they probably won't care, esp. if it's the only bad thing on his credit.

If I could, though, I would try to hurt their business with this..

Good lord he pays more on his car interest rate than I do on my credit card. Refinancing that loan to a 3.9 or better would drop the monthly by $100+

At this point its a he said she said type situation. Her father knew the sales guy fudged his income on the documents and or he did not read what he signed. Leads me to believe you will be stuck with the car since documentation was hastily signed, sealed, and delivered back to the dealer. I still don't understand why he went in looking for a new car to begin with when he owed $6500 on his current vehicle + being on fixed income.

Quit listening to crap here, as to if your dad dies, you owe. A lot of that has to do with each state laws and federal consumer and bankruptcy laws.

My mom died and the credit card companies walked way from her debt.

After I called the doctor today to follow up his appt, they said while he's their favorite patient, I need to start coming to appts with him. Womp.

As I previously mentioned I am going through the same thing with my grandmother so I can relate. But his previous actions/forgetfulness should have been a sign. You really should be and should have been power of attorney for this very reason. Especially knowing hes not with it all the time. All it takes is one time...aka what you're going through now. Its unfortunate and I hope you guys resolve this but based on what you're telling me and the fact that lawyers aren't calling you back means that you don't have much of a case.

He said yes, he finally agreed to the salesperson fine okay if you say I have an extra 600.00 a month then I do.

My dad said, I knew what he wanted me to say, he was shaking his head and winking at me. So I said what he wanted me to say.

But still adding 600.00 would have made his income 2055.00.

They came up with this astronomical 4368.00 per month that he makes saying he gets a pension. Yet had to use two credit cards and took 300.00 out of his bank leaving him only 87.00 for the rest of the month til he got his SS so they could get 1000.00 down payment.

If someone gets 4368.00 per month, and they get it on the 3rd, by the 16th they aren't going to have 1,000 to put down on a car? 2 credit cards and 300.00 from the bank account?

They knew what they were doing. I am SURE the sales person figured I was going to just pay it for him.

You previously describe the behavior of someone suffering from early dementia of some form. With that information and the fact that the credit application was fraudulent, you could likely just tell them both facts and advise them that unless they remedy the situation, you are going to the state attorney generals office and every other applicable regulatory body as well as the lender and local media.

People fake that kind of info on a loan document and rarely stop to consider that depending on the state, they are committing several felonies. Various types of fraud relating specifically to economic crimes (Fraudulently obtaining credit with intent to....), mail fraud, wire fraud etc (depending on how docs were handled) etc etc.

I would go into scorched earth mode and demand they fully remedy the situation with a well researched, well thought through, well laid out and terrifying argument.

I actually had a commercial lease agreement not too long ago, where the agent made up fake tax forms in my name, marked them "filed copies" to indicate they were filed with the IRS and then submitted them to the building owner as well as faked a lot of financials (using numbers he needed, rather than just asking me for the info). I didn't realize until after the deal was done, what he had done. Once i started asking questions and as they weren't doing the improvements agreed to in the lease, I scared the shit out of him to the point he was going to leave the state. It's not the same as just ripping me off, but the point is that these are incredibly serious and game ending crimes, not to mention the civil liability,
