Her reservist commitment amounted to two days a month, she said.

bottom line is, if you can't do the job you are paid to do, then employer should have the right to let you go... so I don't see why there is any drama...

you need someone to give seminars every weekend, someone who is unable to do that is obviously useless to you... there is also the minor detail that reservist can get deployed at moments notice, leaving you, the employer, completely fucked...

Would you keep someone who is unable to do his/her job on the payroll? How can you blame the HR person for doing something that clearly makes sense and is in the best interest of the company?

Not to mention, this has nothing to do with Trump, some mid-level HR person who works at a company that licensed Trump's name made that decision...

it's debatable if that is "penalizing an employee"... that employee is simply unable to perform the job... job requires your presence EVERY weekend to lead a seminar, you are unable to do it, so you don't qualify for the job... seems pretty damn simple...

but of course that didn't stop the employee from using some loophole in the labor law from milking an employer out of a nice chunk of change...

How can you not see the logic? you hire a male model for shoots that you usually do on the weekends... first weekend goes well, next weekend you find out that the guy is in the military and needs to do training every other weekend...

you obviously tell him, "we do shoots every weekend, so I need you to be here every weekend, sorry, but this isn't going to work..."... you let him go, he later sues you... how can you with a straight face say that there is nothing wrong with that? and on top of that, you, an employer who had best intentions, are labeled as some villain?

Being a reservist requires two days a month, plus a week (or perhaps two) twice a year. It really shouldn't be too difficult for an employer to work around that. There are full time doctors who save lives who have employers can figure out a way to allow them to have a single weekend off a month.

Do you honestly mean to tell me that Trump University only operated eight days a month, on Saturdays and Sundays ONLY? So this huge company only worked on weekends? There was no office where had staff working Monday through Friday? They didn't do seminars during the week?

I did some searching and looked for dates of Trump University Seminars.... And found some. They had seminars on August 12 2008, August 13 2008, and August 14 2008. That's a Tuesday, Wednesday, and a Thursday.

It is very simple. If they hired this person knowing that they were in the military reserves and would have to go serve one weekend a month then fired them for not being available on that weekend they are the wrong and violated the law.

If they were not told up front that they were in the military when they hired this person then they could make the case that they need to let them go. Based on the article it seems like they knew and like she even tried to work with them by switching the days she went.
