NO longer allowing affiliates with SEXMEX in domains

Sexmex cash is no longer allowing affiliates that send traffic from domains containing the word sexmex, as we have spent many years building the brand of our company, we have some affiliates that have linked to reality kings, mike in brazil and our site and have even caused confusion amongst customers.

We are no longer going to tolerate this, because we as company have trademarks and intellectual property. That property must be respected. Our trademark is recognized world wide and in likeness, as it is our brand.

Have any other company owners dealt with similar situations?

Why don't you send them emails instead? Companies usually don't allow ad campaigns with their keywords.

Why did spend money on trademarks if you don't transfer those domains to you?

Simply cancel these accounts.

Already getting returns on domain names. Wow, was more and I've gotten one cyber squater banned on another affiliate program for using my trademark to get traffic, then sending it to them they didn't want to be involved in that.

Bottom like, respect intellectual property rights, I'm glad we can all work together.

It's not about serps anymore it's about tube sites, for us as a company with a brand we need to control how that brand is used one affiliate, asked me something and I was fair, he asked me if he could transfer the domain, but maintain the site with his affiliate, he wouldn't promote other programs on the site and I get the final say so. This is reasonable, he's also going to expand on other keywords besides our brand, and is purchasing domains for that, and putting those in his name as they don't contain a trademark.

That's because your looking at the wrong one, we've had it trademarked in Mexico for a very long time, trademarks are internationally recognized, it wouldn't be hard to sue someone in mexico get a judges order from mexico, just because they fail to respond and turn it into the register, nobody has to do business with someone, in particular one affiliate 58% that was using our brand in the domain name. was lost due to chargebacks, chargeback fees issued by the bank, and cancels, and we had people emailing us telling us the bonus sites for mike in brazil and 8th street latinas, his login wasn't working. When 58% of the funds are lost from chargebacks and chargeback fees, and it's creating brand confusion, it's time to part ways, make agreements to pay them whats owed and move on.

Especially when you had asked them to sell not disclosing at that time you have the trademark and they flat out refuse. Rather then being a dick, you try to work with them, but them promoting the other brands on the same domain is really just causing more issues then it's worth, then if 17K comes in and more then 10K is lost from chargebacks or chargeback fees, more then the main site looks suspect.

:stoned I'm getting the exact same amount of refferals

I'm getting the exact same amount of people coming to that domain on accident when trying to come to mine i see it on analytics as referrals, then they are coming to my domain as that's what they were looking for anyway, and I don't need to pay an affiliate for the sale. I've also got no chargebacks today that came from that affiliate. Also it's only fair you shouldn't loose money for "squatting" if you brought a sale when everything was pees and carrots, they should pay you, we aren't burning anyone that did this we just make a major change and contacted those affiliates doing this. Told them enough is enough.

That makes sense, but please at least have it in the TOS on your affiliate program and consider allowing affiliates to promote using your brand for promotion if they ask first. Affiliate marketing using a trademark and false advertising/being misleading are two different things.

In you Affiliate agreement make it clear that exact use of your TM name is prohibited, unless certain conditions are met. Having a affiliate transfer ownership of the domain to you, with an exclusive right to use going back to the affiliate works. Also make it clear that no other program can be marketed by said domain.

The Mexican TM only protects you in Mexico.

From what I saw the Mexican Trademark is for SEXMEX.XXX and EXPO SEXMEX not SEXMEX.

The OP can do whatever he wants but he would be best off treading lightly lest someone nail him for infringing on the trademark by regging the SEXMEX.xxx.

Just for reference, while I was doing research a while back a lawyer advised me that you never want to trademark the whole domain name (with the extension) but you do want to trademark the base name. Otherwise the base name is not protected only the version with the extension is protected.

I'd email your affiliates as doubtful they all hang at GFY or will all see this thread.

Most mainstream affiliate programs disallow using company marks in domain names. search engine advertising, links etc... If ya add all of this to your affiliate terms than no issue. If you give approval to someone to make $ without this being in your terms and then realize they are beating you and then go to take the domain when you told them it was okay to use then not cool.

Personally I avoid using any domain names that contain another companies name as I know it's only a matter a time before they aren't cool with it. Get it in writing if you do receive permission from an affiliate program to use a domain with their mark in it as once your signups begin to make it rain $$$$ they will have a problem with it=take domain, withhold payments, shave, etc... and then all the work ya did defaults to them.

I have individual business phone numbers for a few of my sites but any term discussions are through email which leaves written proof as he said/she said on da phone doesn't hold up too well.

I have a following dickhead, he´s proven this on many times, now even purchasing a nataliek. name, this, not bothering me, if people want me, they´ll come to me, as they do.

Check your affiliates, you´ll probably find those using the sexmex name are not even affiliates to you, so I recommend signing up to NatalieK & make some real money at 1:200

there is no valid trademark on the term SEXMEX in USA, Canada, or in Mexico.

OP has poor information, and no claim to any non .xxx domains containing SEXMEX. Mexican trademark site even offers the domain "sexmex.mx" for sale when you search their database for SEXMEX
