Has anyone stopped offering video?

Has anyone who runs a pay site in here stopped offering video? This is what I am considering doing .... dumping ALL video from my pay sites then mailing cds of all the videos which were available on my site to members who sign up. Every month mail them a new CD.

(1) Would they still have a case since I would no longer be using their technology?

(2) Would they still try to go after me for back licensing fees? Usually a patent owner or a copyright owner will give someone the opportunity to stop infringing before making them pay.

(3) If they did want royalties, would they want them based on my gross sales for the entire year or just for the six months I used video?

I realize that by doing this I would see a sharp decrease in memberships but I'd rather not make any money at all then pay them a fucking nickle. Besides, once their little patent is ruled invalid I will be coming after them for any and all lost revenues.

Actually, I think you're onto something here. Just do stills on the site and upsell or cross sell the CD's with the video content.

no, that is not the way to do it.

i alluded to a solution earlier, and i seriously think this is the way to go about it....at least for the people that dont provide plugins and streams.....

zip up every video you have to offer your members. acacia doesnt have a patent on codecs or the process for downloading files from the internet.

suck my left nut acacia


of course, this doesnt help movie gallery advertisers or plugin/stream people, so in the end the fight must still go on.

still, im going to be zipping up every video on my site from now on.

Will this really work? I'd love to hear opinions from others about this.

How the FUCK can they prove I WAS using videos in past years? Don't you actually have to PROOVE your case before you can win it? Is the legal world that fucked up?

News flash for you I suppose... they're serving people who only do downloads via zip.
Hell, they're serving people who do nothing more than *LINK* to sites that have video. It's crazy.

Well as I stated "they could go after damages..."

They would of course have to take you to court to prove it, but just because you stop serving videos today does not mean they won't take you to court tomorrow for that very issue.

oh, i know they are serving everyone no matter how they present their video.

however, there are many many different codecs and formats....and i can prove that acacia's case doesnt hold water when it comes to me zipping up my video let alone streaming it.

and yes, that includes the streaming of Mpeg-1

Now I'm COMPLETELY confused. You can transmit any type of file via zip. I understand that their patent covers a specific method for transmission of video and audio files, not EVERY method. If the process of transmitting a zip zile falls within the scope of their patent, then why just go after video and audio? If video and audio files are zipped they are no longer being transmitted in the same way.

If they hold the patent on a method of transmission and any type of transmission of video and audio files falls within its scope, then it follows that they own a patent on every type of transmission process on the net, not just the tranmission of certain types of files. Are they claiming to own the patents on all video and audio formats?

The only way that this makes any sense is if the patent covers a specific type of transmission and audio and video files are tranbsmitted differently than are text and image files. If they own the patent on the method by which audio and video files are transmitted, that explains why they are ONLY going after webmasters which employ that specific method of transmission. If the files are all zipped, then you are no longer transmitting them using that technology.

If they are going to come after me for transmitting videos via zip then they should come after everyone who sends any kind of file using that method. If they owned the patent on all video and audio file formats, that would explain why they would NOT go after webmasters who don't use video.

Yeah If you are talking about zipped up downloads on demand, the old BBS systems pretty much put an end to that nonsense.

How can they prove that you have used videos? Are the buying memberships to the sites to capture the pages that have the information?

I havent offered videos on the site yet, and I will probably wait until this thing gets settled before deciding to offer them.

How can they win? The way they've been winning so far.
They file a claim..the defedant doesn't show up, they win by default!

Name an adult industry person that has shown up to court to fight them. I could be wrong (and hope I am), but it seems they either settle out of court or just turn tale when taken to court.
