I think the impa will win. Even if they dont I think it will be tied up for awhile in appeals and stuff.
Then whats to stop a 2nd group of adult companies to group together and challange the patents. and then a third, etc. That 33m will dwindle somewhat quick with a bunch of court battles and not much incoming money. Then what happens when they go after a CNN, Fox, etc. They might get a few mainstream biggies to sign sweetheart deals sorta like they did on the adult side with CE, but some biggies will fight. So in my opinion the eventual result will just be a standstill in the courts. |

From listening to acacia on the d-moneyshow, im not all the convinced that impa will be able to do anything against them except stall it out in the courts, but i think acacia in the end will win.
acacia has $35 + million in the bank to drag this out.

They also have the V-chip appeal, attorney fees, regular overhead, etc. Not sure of their revenue sources but they don't seem plentiful. If they issue new stock to bring in $$$ it would dilute current shares and piss off shareholders. This could run stock below a buck, possibly get them delisted. Seems like they are scrambling a bit. But this is merely my conjecture.

Food for thought.
Mainstream is not stepping up, No AOL, No Microsoft, No Real Networks, No Viacom, Charter, etc. They would have to be stuck on the South pole to not see what has been going on, so I assume they know of these cases and this patent. Could a large company like say Microsoft, who could squash the living hell out of ACACIA if they wanted to, be playing us? Let me elaborate, say IMPAI drags it out in court, we all put up one hell of a fight, do everything that we could do right and the courts rule the ACACIA patent is valid. We as an industry footed the bill to proove their patent, only we are hurt. Meanwhile Microsoft is monitoring the whole damn thing. If ACACIA looses, no big deal life goes on. If they perhaps win and the patent is ruled valid, what would stop Microsoft from pressing one little button and owning ACACIA and its now court tested valid patent? I do not think for a second a company like Microsoft would even blink and dropping 30 million or hell even 100 million to own it, if they got such a patent. |

The more important thing is how much $$ does all of their other subdivisions have? They are some sort of conglomerate. I don't know how they might be able to give themselves injections from other divisions but they could possibly have reserves that no one knows about.
On the stock re-issue, read an article last week from someones link of gfy that they might make a new issue. Happens all the time but would drive their market value down. It'd be a short term cash injection. lol

A good tactic would be to play them back at their own game. Think of ways to rapidly escalate their own costs and also to use up their executive / lawyer time. An old trick that generally works. I don't know enough about the details here but I am sure the IMPA team will. Have thousands of irrelevant tiny companies cause them to answer legal letters each of which requires a lawyer to vet the reply. Get ordinary people worried and have them write to Acacia asking for clarification on xyz. Put word out that they will be targetting personal home sites with images on them next. Bombard Acacia with inquiries and counterproposals. Every person who has received a package, cross out a few lines, add a couple of lines, make sure there is something there that is entirely unacceptable to Acacia (don't be smart or rude, just make some counterproposal that is no less insane than their 2% gross requirement and all the intrusive disclosure stuff), and send it back. When they respond, do it again. Simulaneously get word out amongst the financial world that Acacia is burning at both ends, grasping at straws plus making itself vulnerable to countersuits. I think you could do a heap of damage to their share price and to their whole business survival quite easily. I've been in this kind of business, you need to play the same tactics they are using on you, as a listed public company they are extremely vulnerable to public and banker confidence.

It may also be possible to drag some other mainstream parties into this by the same tactics. If M$ receive 10's of thousands of emails that people believe the wmv format can no longer be used because of this, if people email them asking if they have supplied a product that is not properly licensed. There will be angles in this for AOL, for government agencies, for civil rights groups, for business groups that defend business independence and freedom. Get it out there that Acacia is causing a hell of a lot of hassle for ordinary people. Make sure everyone knows they are asking $1,500 settlement (plus future fees and intrusive information requirements) from people making no money at all from their use of the technology (i.e. those earning $0 - whatever the first bracket level is).
