I just saw this url posted on another board.

Wow! What would happen if all of the companies tried to make the link lists gather proof from everyone who posted with them that they own the rights to the pictures they are posting...that would be a nightmare!

Anyone know if they are doing this to everyone, or just this site????

Personally I have a disclaimer on my sites concerning links(accepts no responsibility for any outside link you may follow on this site or the content you may find herein, blah,blah,...)

If a linklist has a written privacy statement located on there site the lawyers have nothing.

A link list is a public place for other people to submit sites. If they were to be sued that party can say there system is automated and they do not check sites.

Or, they can state they have no control over what other webmasters do with there sites, that party is sole ownership of that site and we cannot condone what they display within there site. Furthermore the link list has no legal copyright infringment(sp) only the owner of the website that was submitted and so that content provider needs to contact that webmaster and take it up with him.

heh =O) i have a family of lawyers, thats all off the top of my head pretty much. if you want more detail let me know.

I never made it through law school, but here it is as I see it.

Looking at the case of sex.com, it was ruled that a domain or web address was just like a phone number. So with that as a precedent, links lists would be really hard to hold responsible for anything.

Of course Luciano's is based on mostly on sites with playboy models and stuff, so he's alot more open to it than most. It could be argued that he's not only promoting the stolen content his whole site is built around it.

Also Perfect 10 is fucking hardcore when it comes to protecting their material, they don't think it's funny at all.

It'll be interesting to see what happens, but I don't think it will affect link sites in general, just the ones that focus on "centerfolds"

Thats crazy,

They have no case, that would be like sueing Yahoo for a Site that is listed in there directory. But hes not Yahoo and thats the only reason I can see them fucking with him, I think they honestly know they have no case either. Hopefully there are some good lawers out there willing to help him.

I just saw his url posted about his letter, I never saw this site before he posted that so I wasn't sure what type of content he had up, or what sites he was linking to.

My sister was in a chat room yesterday and said "these people are all posting pictures, do you want me to save some for you to post on your sites?" And I explained again that I can't do that, I'm opening myself up too much.

The very first site I built I used some "public domain" stuff, then I got on the adult webmaster boards and found out there was not "public domain" and quickly changed everything to sponsor content until I could afford to buy it.

But my only site that has links on it (more for trading than anything else) I don't even think about checking to see if they have licenses to their content.

It will be interesting to see how this shakes out for him. I wonder if he will get any more letters, or now that he took all the links down they will leave him alone?

Whether or not anything happens, Luc's is gonna lose alot of traffic in the meantime. Freeloaders are loyal, but not that loyal.

Cam's right, is Yahoo requiring any proof of ownership?
