Don't know why no one can answer this question. Even my own attorney.
If you only have a driver license ID and no other ID ...are you not in compliance with 2257.
Can you go to jail for 5 years for only having a drivers lisence??

I'm pretty sure a US drivers license is fine, but to be on the safe side get two IDs. The whole 2257 thing when Traci Lordds with a single forged ID worked in the porn business. She was 15 at the time.

Two IDs are harder to forge than one.

I read it as... you must have 2 forms... I say that because it says that you must physically inspect the Identifacation documents. Not document...

So by the letter of the law... you must have had the id's in your hot little hands.... not a photocopy or photo of them... Correct me if I am wrong...

So if you don't have two ID's you go to prison for 5 years for not being 2257 compliant??

You need a new attorney and apparently...so do others in this thread.

The law says 1 ID is fine if it includes a recent picture and all the other elements that are required. Most drivers licenses are sufficient.

That is why they are strenghting the laws.

I've been in this business a long time and dealt with 2257 and the legal side for over two decades. One thing I've learnt is doing the minimum is never enough.

Get a lawyer to tell you what you should do, not a bunch of board posters who have no legal training. However here is advice for those who can't afford a lawyer.

If you ever are pulled in front of a judge or visited by police with a search warrant, doing the most you could will work in your favour, doing the least you should will work against you.

We supply customers with content that has two IDs, we shoot a picture of the model holding them next to her or his face. This is a different shot on every set we shoot. We also supply a model release with every set, we hold a model release in Czech.

Why?

Models sue publishers, saying that they did not sigh a model release for that shoot. Bit stupid when they are asked why they posed holding their IDs for that SET.

Models dispute they did not understand what they were signing, can't say that if the contract is in their first language.

Models say they were not paid, look real stupid when they are shown a check stub or a legal reciept for payment recieved.

Underage people forge/steal IDs to get into porn, Remember 2257 started with Traci Lords and a forged ID. Harder to forge/steal two than one.

Models dispute that it's their signature on a model release, so we only accept models with one of their two Goverment Issued IDs cotaining a readable ID.

Sadly producers forge signatures, more likely to spot it if you have an ID with a signature.

Sadly producers sell content from a "Test" shoot. easy to spot it was not a test shoot if the model is holding the IDs beside her face on that very set.

None of the above are concerned or dealt with by 2257, but all of the above can land you in criminal or civil court.

No one knows if or what will happen with 2257, how it will change, if it will change, how it will be enforced, if it will be enforced, etc. you can only be cautious and prepared.

When the new 2257 amendments came out we contacted a few of our magazine clients. Hustler, Score, PRO etc. all employ full time lawyers, to ask about the changes, They told us not to worry our documentation was compliant.

Your call, we will carry on doing it our way what ever others say we do not need to do. Unless they tightenit againa nd we will adept to that.

I doubt if any will spend time in prison for bad record keeping.

What is more likely to happen is a big lawyers bill to keep out of prison or fend off a models lawyer who thinks there's low hanging fruit to be plucked.

You won't go to prison, might lose your house though.

One last thing.

If you are buying content it's easier to tell if you're buying from a legitimate seller if you get the documents. Model Releases should tell you who owns the copyright.

Again easier with than without.

Stop trying to scare people, no one is going to go to jail for naked grand mothers. They might spend $10K staying out of jail and get a fine, but jail is very unlikely.

Ashcroft changed the rules because he was asked by Congress why he had not carried out any investigations with the then regulation. His answer was the law was not right and he would tighten it up.

But filling jails with people on paperwork offenses will not happen, unless those people are doing extrweme stuff, then it's a lovely tool to make easier to inprison. Most will end up with a whacking fine and a lawyers bill.

Here's another reason to get the 2257 documents. The law said you did not require them but they should be held by the producer. The law has been changed and now many are left looking for companies that no longer exist or brokers who listed the producer as Custodian and he's over seas.

Haremgroup were selling content and now disappeared, so anyone in the US who bought their content has a choice, take the risk or dump it.

As for webmasters being interested in this, they would rather talk about beer.
