I dont think anybody is fully ready now and if they claim to be chances are they are missing something. All the top attornies are arguing over what the new regs are and how to be compliant. How is one sponsor already ready. I am waiting for my attorney to say "duke this is what you have to do and this is how." If I am to just go off on my own and follow what I "interpurt" the law to be I jeprodize myself, my partners, my affiliates and my models. I will wait until I get all the info i need and act appropiatley. Being ready now, unless the person is a first ammendant lawyer/affiliate program owner, i would seriously doubt they are ready, because the attornies arent even ready to tell us what to do yet themselves.

If you dont know or cant tell what a compliant 2257 sponsor is then you realy need to fine another line of work.


Most sponsors that have a clue have been comploant for 8 months or more... well before the shit hit the fan.

All my shooting clients have been made complient by the new regs way back in Aug of last year. The people that are starting or worried about threads like this will be out of business or in jail by this time next year. If you arnt compliant now.. you will never be by June 23. Where were you a year ago when this all hit? Thinking it would go away? hmmm good business plan.

It's not too hard to be in compliance. Especially being that we dont have tons of content. How could anyone have been in compliance 8 months ago when the latest regs were just realeased? Sure, everybody is doing what the new law states to the best of their knowledge. We started awhile ago *to the best of our knowledge* But i want to wait for my attorney to tell me I am in compliance before I go shooting my mouth off that I am. That's smart business.

The regs/proposal of Aug of last year were more strick then the lastest actual regs.. We/I used those to make sure I was covered by the ones of last summer and beleive me... I am as well as many that I work with. Many programs, well and above whats on your little list Funny how people ignored all that last summer and now its getting them in the ass.

If you are waiting or have waited for your attorney to tell you what to do then Im afraid you are a year to late. We were doing mock 2257 inspections in August of last year based on the proposed regs to the current regs which were much more strict. We had our lawyers into this a year ago and made a business decision in July of last year to bring everything we have to full compliance by the standards set by the proposed regs. Most everyone else was saying it would never happen. hahaha! Go ahead.. wait for your injunction... and when it does not happen or the regs go through anyways... what then? It takes more then a few days to build this data base ya know.

Also, if you think giving the models id to affiliates is a good idea and part of your business plan if an injunction does not go through, then you are a fool.

I'm not clear. Are you refering only to sponsors passing out ID's to affiliates, or are you saying content providers should not be providing unobfuscated ID's?

All I said is im waiting for an offical inspection from my attorney to make sure I am in compliance, and give me the seal of approval. As far as I know we are. I want to hear it from my attorney first.
And as far as models ID's go, its not my idea to give them out. it's the doj's. How do you expect to run a cash program without affiliates? And, now that affiliates are secondary producers, how do i get around that? Do you run a cash program? Let me know.

Yeah seriously, you guys need to lay off Duke. I'm sure every sponsor wants to be compliant, but we've heard the same things from our lawyer...so we are waiting as well. Should it be nessessary to jeprodize every model we've ever shot's privacy to stay in business, we will do so.

It's really a damned if you do / damned if you don't situation.

I doubt that anyone is this business is more concerned about this than me, but if you ask almost any top attorney...they will say that it is still too early to know exactly how to handle this. There is a lot of gray area in the new laws that needs to be sorted out, so going of half cocked isn't helping anyone.

I know for me... I have an "official" program waiting to open once the 2257 dust settles, but I will be screening ALL affiliates before I hand out IDs and dropping any affiliates who signed up and don't really send any traffic or sales to me.

With that said, not a single ID will be given out until June 23.

Our best converting site Pornstar Classics is exempt from 2257 along with two new Classic sites going live in June although, we are waiting on a final analysis from our lawyer as to the exact requirements with regards to the 2257 Exemption Statement.

All our non-exempt sites we have our docs in place but again, are waiting on making an official release until we've discussed with legal.

We not lawyers and don't want to officially post where we stand until we have an indepth legal meeting on the Regs. I suspect this is why you are not hearing back from many sponsors in this post.

But, this is where Smashbucks is at the moment on this subject.

There is no way to tell unless you ask. Part of being compliant is giving out the IDs. This is the 2nd thread I have asked who is complient and THREE have said yes.


Are they giving out IDs? if not... They are not compliant yet. If so, they need to make that info public so we can switch to them. I know several programs who are NOT going to give out that information.

Affiliates will have to show more information I guess. Provide refferences ect.. I dont fully know what we will do as far as that, but I'm sure my attorney will find a workable solution.
however, if the girls were to stand up for their rights and lobby we would all be ok.
This is a catch 22 for sure.. You step up affiliate requirememnts you loose them. You start passing around ID's you loose the models. I also definatley see "hobbyist producers" who film and shoe box the content talking shit about the peopel who have to give out the id's to keep their program in business. This would be a great way to get the girls all to themselves. You would be surprised how much shit you hear from models from hobbyist producers. AND NONE OF THE ONES WHO TALK SHIT ARE ANYTHING OR ANYBODY. I traded girls with Jules Jordan. I dont hear him talking shit. Giving out model IDs. This is really a bitch of the new Regs. Not to sound like a broken record but we are waiting to review with legal in this and everything else. One of my questions I have is if this is even legal for us to do with all of California's privacy laws. And god forbid some crazy stalker got an ID from us and then committed a crime against a model? I'm sure some distraught family members would try to hold us responsible too.

Shooting_Manic, How do you expect a sponser to be compliant without giving the affiliates the ID's? I think you are confusing the 2257 regs for the producer vs. the 2257's that will make secondary producers legal. Most decent producers are 2257 complaint. It's the new secondary producer regulations that make this law assanine and difficult to follow. In order for our affiliates to be legal. they must have the ID's as well.
