I know I know lame thread but will Adult.com start requiring 2257 info to be included when making some crappy 'Would you hit it thread'? Will the new 2257 regs then be end of not only thumb tgps that take webmaster submissions as well as 'Would you hit it' threads? Oh my God.

Large forum sites are excluded from the regulations:


(4) Producer does not include persons whose activities relating to the visual depiction of actual sexually explicit conduct are limited to the following:

(i) Photo or film processing, including digitization of previously existing visual depictions, as part of a commercial enterprise, with no other commercial interest in the sexually explicit material, printing, and video duplicators;

(ii) Mere distribution;

(iii) Any activity, other than those activities identified in
paragraphs (c) (1) and (2) of this section, that does not involve the hiring, contracting for, managing, or otherwise arranging for the participation of the depicted performers;

(iv) A provider of web-hosting services who does not, and
reasonably cannot, manage the sexually explicit content of the computer site or service; or

(v) A provider of an electronic communication service or remote computing service who does not, and reasonably cannot, manage the sexually explicit content of the computer site or service.


Read "v" above. It would be impossible for Lensman or the owner of any large forum to moderate every post made on the site. He can respond to complaints, but he could not watch every post made in real time.

2257 governs commercial services, so no, it would not be required. I can put nudity on my personal website, but not if its commercially driven. And, as mentioned by the post above, the board operators merely provide a medium, as does an ISP, rather than being directly responsible for the content.


Now that "commercial" provision could possibly extend to GFY sigwhores

Taking advantage of a loophole in the laws requires fighting it in court. Fighting it in court requires time and money for legal expenses. Making it to court requires being ARRESTED.

Go ahead, look for a loophole if you want, but it certainly can backfire.

Probably not, because someone is approving the submissions.

If you had a "TGP" where anyone who wanted to could submit anything they wanted to and all submissions were automatically approved by a script and it was so busy that you could not "reasonably" monitor it, then you would have an argument.

TGPs submissions are reviewed by the site before they are posted. Forum posts on a large forum could never be moderated in that way.

if you are a content producer hyping your product you best have 2257 info on anything you submit if you are USA based, which will include proper info, proper point size, etc on your website.
