I could be wrong, since I'm not a lawyer, however *if* there are 10 fairly large sponsors who have documented proof *SnagIt allows you to screencap via video your every move on a screen, BTW* , meaning that the spyware installs itself, they click a link to a sponsor and instead of going to fabuloussexsitea.com it goes to theirfabuloussexsiteb.com - they can send a C&D to stop those practices and if they continue I do believe they have grounds to sue in a class action lawsuit for unfair business practices and for hijacking their business & if they can't do it on those grounds, I'm sure they can find members who tried to signup to fabuloussexsitea.com and got redirected and charged by theirfabuloussexsiteb.com.

Actually just quoting something from someone who worked as an expert in similar lawsuits against Gator:

The actual term for the sponsors could possibly be:
"Alleging false advertising, unfair competition, trade libel, and tortious interference with prospective economic advantage"

Guys, I've been using Adbrite on our network of sites for months now and I've never seen anything like this. Further, our fans are EXTREMELY vocal when anything fucks up. Haven't heard squat. I'd bet this is more a case of what Lars mentioned. Spyware targeting adbrite's code. We had something similar a few years back where spyware was targeting ConsumptionJunction.com. Anyone infected that visited our site got a pop-up advert everytime they clicked one of our navigation links. We got blamed for it by our fans and we weren't even doing it.

Either way, I've got a long relationship with these guys and I doubt very seriously that they're doing this. I've emailed my rep over there and the CEO / Founder of the company. I'd expect an official response as soon as they get their GFY accounts approved. I also offered to post for them until that happens.

Bottom line, we've made a grip of money with these guys and never had any problems. I highly recommend using them.

Not that I wanted to bump this thread to the top, but I saw it and thought I'd respond.

AdBrite doesn't do any type of browser hijacking. We also don't do popups, direct links (SEO spam), or anything else sketchy. In fact, we didn't even set cookies until recently, when we couldn't figure out any other way to do conversion tracking (code that shows advertisers which of their ads are converting into actual sales).

Most likely your site is having a problem with our Interstitial/Intermission code. Interstitials are full-screen ads with a big "Skip this ad" link on the upper-right.

We have heard on occasion of these ads sometimes performing weirdly on sites with lots of other JavaScript/CSS/DHTML stuff going on. If that is the case, you can go into your AdBrite account and turn off Interstitials. Also it would be helpful if you could send us your URL, so we can debug. We'll send you a free tshirt or something for your troubles. Consider it hush money.

Sorry for any inconvenience. Everyone should be aware that Interstitials are (and always have been) by default OFF for all publishers. If a publisher is interested in these types of ads for his site (starts at $5 cpm! okay there's my plug), he must manually turn this option on himself.

As for the browser hijacking, I thought that kind of thing was very risky for a reputable company to engage in, what are your opinions on it, perhaps someone else had a negative experience with this company?
were you using the interstitial ads? as the person from adbrite mentioned above, there have been some issues where the URL being shown in the intermission ad is breaking out of the iframe and the surfer is no longer able to click on the 'continue to xxx page' because the frame is busted and the URL being loaded is now 100% full screen. you can't hit the 'back' button because in effect, the URL is loaded like a console so there is no page to go back to...

i've bought some adbrite traffic via this method and that complaint got back to me from some advertisers...it has something to do with competing javascripts from the adbrite code and the pages being loaded.

I have tried many times to contact Adbrite via their contact page and e-mails and I even stopped by and talked to one of their guys at their booth in NYC. Not even one e-mail or phone call back...
