How would it kill them? Not allowing them to act like they have the video and not? If they are providing the video for sale thru Xpays then its allowed? Seems pretty simple to me?

As a content company owner I wholeheartedly support Xpays. The videos are owned. Just because they were pirated doesn't make it right for those who profit through illegetimate publication/endorsement of them.

If you can't write a "review" with images from the movie... or post a "news" article with images unless you have permission or are paying a royalty, then those types of sites will die.

As business owners they are entitled to defend any copyrighted material which they own the rights to. And yes as long as the owners have never ever illegally downloaded any copyrighted mp3's or movies then yes I support them.

I support copyright ownership and the ability to profit or not off of it.
I also support that fair usage should be upheld for the partial use (clip, story, review, so forth) of newsworthy items and or celebrities. Even if the reviewer does not send sales, traffic, or pay royalties to copyright holder. Though I feel they would be liable if they sent traffic to someone else who did not hold the copyright and sold them the video.

I don't know all of the details of the case, however I don't think this is a frivilous lawsuit inasmuch as Evan (Xpays) has made it abundantly (and redundently) clear, that Xpays will go after copyright violaters - they provided plenty of fair warning.

When you dabble in the gray area, be prepared, and when you get into the darker areas, look out.

I think you would be hard pressed to find many content creators who believe copyright infringement is okay, and the same is probably true for most people that own or are granted rights through the licensing of copyrighted content.

Kind of hard to operate a business if everyone is stealing your content and reaping profits that rightfully belong to you.

I support his right to go after people. If he took the risk in paying big bucks for it, he should be the only ones profiting from it. I do think his gloating about lawsuits and scare tactics do scare away potential affiliates.

I see it pretty black and white really.

Xpays own the video

Other businesses were selling the video without xpays permission via there own billing.

Say I had gone and ripped mrskin etc website and copied the code and made a complete copy. Would this be allowed ? no. They have copyright over it.

Same with xpays.

Just because this video is majorly popular does not make the law all the colours of the rainbow.

I laugh at some of the hypocricy, that when someone steals someones normal porn content. all hell is blown loose on the forums and everyone agrees with the original content holder and calls the other a theif and a scammer.

Same with xpays, they own the fucking video! therefore noone should copy it.

I do not see how some people on this board are sticking up for those at fault.

I also believe xpays have gone the right way about this aswell. They warned people before hand. they made threats and thankfully they have gone through with those threats. Good riddance to theifs, whoever they may be.

So every person out there that runs a blog and posts about it with screen captures and maybe a video clip should be forced to sign up to XPays first? Even if they're primarily mainstream? What about new agencies?? Is XPays going to make every news agency out there pay them or put up links to them for using the term "Hotel Heiress"? I agree they should have the right to enforce their copyright on it.

I think it's been made clear for a long time that this video, much like Playboy, Perfect 10, and Suz Randall are shit you need to stay away from (amung others).

However, I do not agree with the way this is being blown up into a huge issue. It's going to send a ripple effect to others who are int he celebrity niche, even those NOT in hardcore.

It reminds me of the stuff with the RIAA a few years back.

I'm not saying the Xpays should not enforce it. Nor that they do not have the rights, because they obviously do. I just do not agree with the broader implications this brings.

I'm split 50/50 for several reasons, and I think they could handle it much better and make a lot more money. However, I hesitate to do much business with them and am constantly reconsidering it because they are always trying to sue someone, always threatening people, including affiliates, getting their own affiliates pages DMCA'd, etc.. It's just EASIER to avoid them and their program, and easier to stop finding traffic to send them.

I can't remember Evan and I agreeing on much of anything. I haven't been a fan of some of his business, umm, "concepts" in the past, so we aren't exactly on the same page.

To an extent, the idea of legal action in this particular case is good. Exclusivity of license is an important issue, and rights holders need to agressively and jealously protect those rights.

However, specifically in the case of Mr Skin, well, I am not seeing the same application here. Mostly for the reasons that all of Mr Skin's content is lifted from other sources, and from companies with MUCH deeper pockets and stars to protect. However, judging from the specific lack of action on the behlf of the studios to get their copyrighted material removed suggests to me that there is a reason, maybe a legal angle that protects them.

I think all of the others look pretty cut and dry, if Xpays is the only license holder, and they have not granted a license to anyone else (or have granted limited license that doesn't allow redistribution) than I think they are pretty much good to go.

Of course, they might also want to try to sue the usenet and every ISP and company that distributes it, because the hilton video is "out there".

Freedom of speech typically trumps copyright... Of course it depends on the application etc.

Looks like I jumped the gun. I said yes but that is only if they were actually selling the video. I see MrSkin says they just did a review and if they are getting sued for that it's pathetic.
