I love those that think anyone is untouchable.

And any of you stupid fucks living in those countries, or operating similar illegal sites should keep your mouths shut, stay under the radar and make the money while you can. All good things (and bad) come to an end at some point.

good for them
you should be sending them notices that are complient with the German = of the DMCA

and not trying to force them to obey American Laws

I was just going to ask basically the exact same question, why should they be paying any attention to a DMCA notice? (of course I'm asking from a legal perspective not a common sense stolen content one) it appears they're fully outside of the US... The bandwidth providers on the other hand may pay some attention.

The simplified answer is international cooperation in enforcement of intellectual property. Most countries, including Germany and the US, do have an operational treaty or agreement that each will recognize the intellectual property rights conferred by the other at some level.
Thus, if a German producer sends a notice to a US host that his stolen German content is being hosted on the US host, the US host will take that down.

are you talking about the Berne Convention
because if you are there is a massive difference between recognizing "intellectual property rights" (your trademark/patent/copyright registered in your country is valid UNDER my countries laws)
to your countries laws supercede my countries laws.

in your example a german producer would still have to send DMCA complient notice instead of his countries = because he would be respecting the validity of US laws (he also would want to since DMCA is stricter than the German =)

I am not sure what really happened but the site is down -- and this message is on their page:

Due to a Hardware Crash we're temporary down.

Instead of waiting for our Provider to fix that, we're leaving to another country ( NL )
We're back in Approximatly 48 hours on even Faster Machines!!

Don't stop your Torrents.. leave your Clients ONLINE.. so we dont loose our content

My guess is that someone that I contacted decided this was not a website they should be hosting!

Thank you everybody for your help and advice.

Unless they really DID have a hardware crash that was so awful and that servers4you just could not handle that the accused thieves had to move their operation to another country..........

What host will have this site next week??

Well... They would still exist, but at least they wouldn't be collecting a paycheque off someone elses work. Piracy on the net was around long before dating affiliate programs.

Yes but it was piracy in another form, now its paid for with ads thats the only way they can make money off of it. Any processing they get is killed pretty quickly. Its not like the guy on the corner selling knocks off for cash.Kill the ads you kill the cash flow. Now someone wants to make a BT full of content they paid to produce and give it away more power to them.
