Technically it is illegal to pass on the right, and it is illegal to drive in the left hand lane unless you are passing someone.

Rarely enforced, but it is the law.

I think if they actually did enforce people only passing while in the left hand lane people wouldn't have to pass on the right.

wait a minute... can you please explain this to me so i am 100% understanding of this. You are saying i should not drive in the right lane of a 3 lane highway if someone is in the middle and i pass them??? That i should change lanes to the left when i can and then get back over to the middle? i really never thought that it was illegal to drive in the right lane and pass cars in the middle lane, been doing it for 11 years now. Plus i just think the cop gave me that summons since i was speeding, excessively yes, at 73mph in a 55mph zone. I think he did it to bust my balls. I always feel that if a cop is giving attitude its because he is unfortunately doing the late night shift, and i am a young guy in a nice car.

this was my first time being pulled over in NJ by a cop and man was he a prick to me. I have been pulled over many times in NY and Miami but this guy was the worst except for a state trooper in upstate NY just outside of Oneonta lol that guy bent me over and patted me down and pulled out his black cop stick thingy on me to scare me... i was 20 at the time and almost crapped my pants... loli dont think i sped for a year after that incident lol

i dont know if its a 4 point. The summons is different than what they issue in NY. He circled under traffic offenses (Title 39)

4-98 speeding 73 in 50 or 55 (cant tell by his handwriting)
4-85 improper passing.

i have to go to court Dec 6 at 845am OUCH... gonna have to get up super early to beat traffic to get their on time, DAYUM!!!

This is why I'll typically flash my brights at someone in the left-hand lane, and try to persuade them to merge over to the right before I whip around them, if called for.

I try to not make a habit of passing people on the right.

Keep right, pass left is nj law. Its pretty wise not to pass a cop; they take it personally. Especially if he/she is trying to slow down the flow of traffic. I did that once and he said he had to pull me over otherwise i'd ruin the example he was trying to set. He let me go which was cool. I have had no such luck as of late. I used to be able to talk my way out of pretty much any moving violation; now i talk myself into them.

i use to flash but i dont knwo what happened in the last 3 years in NY & NJ....they dont move over for shit and they most of the time slow down on purpose. so i would always go to next lane and pass by...i guess i will go back to flashing

Passing on the right is only allowed under certain circumstances.

CVC21754. The driver of a motor vehicle may overtake and pass to the
right of another vehicle only under the following conditions:
(a) When the vehicle overtaken is making or about to make a left
turn.
(b) Upon a highway within a business or residence district with
unobstructed pavement of sufficient width for two or more lines of
moving vehicles in the direction of travel.
(c) Upon any highway outside of a business or residence district
with unobstructed pavement of sufficient width and clearly marked for
two or more lines of moving traffic in the direction of travel.
(d) Upon a one-way street.
(e) Upon a highway divided into two roadways where traffic is
restricted to one direction upon each of such roadways.
The provisions of this section shall not relieve the driver of a
slow moving vehicle from the duty to drive as closely as practicable
to the right hand edge of the roadway.

They share databases. Yes, your insurance will (most likely) be affected. Most states have a traffic school, or something set up so if you don't get another citation for a year, it goes off your record. Of course, if you do get another you are pretty screwed.

They are using Chargers in Indiana as well . . . which probably explains why traffic in front of me always seems to slow down when I pull up behind them.

As shown by my post citing CVC 21754, there are exceptions to the rule. I would have to look up the laws of the state in question to be sure. But as stated earlier, that slower vehicle should be to the right anyway so it wasn't an issue.

Rarely enforced, but it is the law.
It's enforced more in the North East, they need to enforce it everywhere.

Florida is insane- people always driving under the speed limit in the left lane, making people pass on the right, frustrates the hell out of me.

Also if you are floating in the left lane and someone is coming up behind you who is moving faster, if the other lane is clear, don't be a dick, move to the right.

pretty sure the speeding is 0 points but your definitely getting 4 points for the improper passing, make the court date usually they ( the officer ) won't show and they'll reduce the charges.

yea, i am definitely going to court... i will beg the court for forgiveness if i have to, i dont want the points, my insurance is ridiculous as it is...I have no problem paying for my speeding since i was in teh wrong but for me to get a ticket for driving in the right lane and passing cars in the middle lane....

i just want to make 1 thing clear, maybe this is different, i was in the right lane from the get go. i was just going faster than middle lane and passed by the cars...i did not shoot out from the center lane to maneuver around.... does that help my case for when i go to court???

Having spent many, many hours in the courtroom I can say without qualification that the most common mistake made by people representing themselves is saying too much, thus convicting themselves.

That would be a perfect example.
