Again nothing new, I see tons of stolen content on Fling all the time. Of course their excuse is always "it must be a member doing it". Bullshit.
Unless members make their banners for them, they are thieves. They produce more content in a week than most of us that they steal from do in a month, so why not use their own content to promote themselves? Below is a banner using my copyrighted content. Unbelievable.

That looks like a banner that rotates random fling images through it. It's obviously some member is using her image to phish out fling members. It happens everyday, I am sure she is on every dating site known to man kind.

Using the pictures and movies for anything else is a copyright infringement, as prohibited by the U.S. Copyright Act, 17 U.S.C. 101 et seq., (see http://lcweb.loc.gov/copyright/title17/) and International copyright law and is in direct violation of the international rights of the copyright owner. We have someone at our office that does nothing other than surf the web and TGPs to find webmasters using our content and not following our rules. Violaters and their host are then sent a letter from our lawyer, via certified mail, with a cease and desist. Hosts, especially including free hosts, will always take down the content since they are liable too. If the content is still not taken down the cost per picture and/or movie is $6 per day (so if you have a 25 pic gallery that is costing you $150 per day..it is much easier to just follow the rules). COPYRIGHT INFRINGEMENT IS AN OPEN AND CLOSED CASE IN COURT AND WE HAVE SUCCESSFULLY PROSECUTED WEBMASTERS THAT HAVE VIOLATED OUR RULES." I am espescially fond of that last sentence.

It makes sense to me that Fling would put 'member' pics in rotation - the more clicks they get then the more they appear in that rotation.
That would explain the problem... however as they have been informed of this before they need to look at a new way of doing things, or they will get this all the time. I cant see they would do this on purpose - I am pretty shaw they have a pretty large collection of pics themselves |

It is always better to resolve this behind close doors. Bringing in an attorney gets costly, plus time and effort on your part. I have been sued and have sued people. The easiest way is to resolve this behind close doors unless the other guy is a complete asshole and unreasonable.

It would be very easy to create a database of "approved members", that would all be verified and incredibly hot, that would be used for the banners.
This would kill two birds with one stone and would be very easy to set up.
