The owners of the company that makes the Whizzinator, a prosthetic penis used to mask illegal drug use, were charged yesterday in federal court with conspiracy to defraud the government and are expected to plead guilty.

Gerald Wills, the president of Puck Technology, based in Signal Hill, Calif., and Robert D. Catalano, the vice president, are charged in a 19-page criminal information of conspiracy for selling two different products that mask illegal substances in a user's urine.

The products, the Whizzinator and Number 1, are sold through the company's Web sites.

As part of the case, the government is moving for forfeiture of all of the company's assets, as well as its Internet domain names.

The charges were brought, at least in part, after undercover law enforcement officers ordered one of each product and had them shipped to the Western District of Pennsylvania.

According to the criminal informations, the company and its owners defrauded the government's Substance Abuse and Mental Health Services Administration, which is tasked with overseeing federal workplace drug testing programs.

The company conducted its business very much in public, including testimonials on its Web sites, including one from a truck driver who said he was able to beat quarterly drug tests by the Department of Transportation using its products.

Stanton D. Levenson, who represents the company, previously said that he didn't think the government could make a drug paraphernalia case against his client.

But yesterday, Mr. Levenson said he did research that showed his earlier opinion was wrong.

"We're convinced that the government's theory is correct, and the government has a case," he said. "Obviously, it's serious if somebody is faking drug tests who is then driving a tractor-trailer or a bus or flying an airplane."

What the hell does that have to do with the constitutionality of urine testing?

Debating the legality, or human rights, issues regarding drug tests, has zero to do with whether or not it should be legal to drive while under the influence.

It should always be illegal to drive while under the influence of a substance, however, that has nothing to do with whether or not you should be fired because you smoked a joint over the weekend and test positive for it on Wednesday.

Maybe you can debate this stuff when you get out of highschool?

If they had been more discreet about the product's use, they probably could have gotten away with it just like head shops get away with selling flavored rolling papers, vaporizers and water pipes... all for tobacco use only, of course! Just pass this thing off as a way to fool your crazy husband/wife who wants to test your urine for cig smoking. Guess it's too late now!

Typically once the US government sets its sites on you, you end up fucked and more likely than not no amount of money will get you out of it.

Hell go find the documentary about Tommy Chong and his conviction for his kids pipe company. He also got cornered into taking a plea and a plug up the ass. Nothing is off limits to them, they threaten friends, family, you name it. A plea bargain can start to look very good.

Why I often cringe when I see others flaunt and taunt the government and the fuckhead prosecutors. Once one of the main tools in charge points their finger your direction and says you! That is the absolute truth. All it takes is one person in the govt. to target you for any reason, and then they make you their project and you're going down. It ain't right, and it ain't the way it's supposed to be, but it's the way it is.

Maybe a "stoner" lawyer. I don't mean that in a disrespective way, but perhaps he's too laid back / trusting of others.

Alternatively, it could simply be that the Whizzinator folks were too cheap / lazy to hire a top-notch experienced attorney.

I also think piss testing is an invaison of privacy. (That said I'm kinda up in the air about who should willingly submit to one to keep their job, Pilots come to mind here. So maybe if pilots for instance want to do the job and earn the pay that comes with it, it's in the contract. That's up to them.)

OK, I'm reading this thinking WTF was the lawyer thinking also. I mean did their ads target the government? are all drug tests government? I'm sure that they could beaten this as drug paraphernalia.
