Navisite / Jupiter Hosting Settlement Offer. Almost Done.

Im real close to taking this settlement offer. But I still dont know.
The latest offer (keeps getting lower and lower) is $3,000.00 total. With monthly payments of $1,000.00

Original Debt over $9,000.00 over a contract dispute as some of you may remember.

A smart man would just take this and put it behind him. But im having a hard time doing it. The contract is right in front of me. 1st payment due next week.

Deal or No Deal?

3k is still 3k and a shakedown is still a shakedown.

I could finally put this bullshit behind me. All the harassment all the crap. The collections, the scumbag attorney-s with the empty threats.

But if they havent been able to touch me in the last 16 monhts I dont think they can now.

One thing I did notice on this contract is that they have me down as BP4L Media and not my real name.

At the time of the contract I had the contract written up as BP4L Media. (there is no such thing) but I signed it as "mike jones" my unofficial but not legal name.

So im wondering if they really could do anything now.

However the collection agents seem to have my actual info. they must have gotten it from American Express the credit card Id use on file to pay all the monthly bills before i left.

Im wondering if they even have a leg on this not even having my real name on this contract now.

I think the whole thing sucks....and I think the company sucks.......but at the end of the day you're the one who signed the contract and didn't pay attention to the details.

I realize the Jupiter folks were your friends but at least you shoulda pulled out the contract and read it once they sold to these other guys.

It's not a shakedown when it's a legitimate debt.......I mean it's stupid and it sucks and it's downright scheister-like to have a clause like that in a contract....but it's in the contract and you did sign it, so pay up and quit whining.

I signed a 1 year contract. Stayed for over 3 years.

Paid every month on time. Paid 100% up till the day I left with notice. I left, paid all dues and they closed my servers and I moved on.

5 months later they come knocking saying they want 9k. I ask for what. They say becasue I left early.

The contract was auto renewing every year. On the month of October to be exact. I left on November. Paid up till then. 5 months later after ive been gone they say oh by the way you left early and you still need to pay us for the year.

Im dealing all in house.

The local attorney here that was harassing me, I waited for him to get off work last month and walked up to him at his car to "talk" to him.

He since has not bothered me.

People have told me since day one to get an attorney to do this for me. There's nothing a balless attorney could do for me that I havent already done. I doubt an attorney could have talked me down this low in a settlement as I have. He would have wanted a cut and a fee as well.

Im good with people.

Take it, that's a pretty good deal, you knocked off nearly 70% of the original amount owing and you were able to defer the amount over 3 months. Make sure you get a settlement agreement in writing before hand, do not under any circumstance make payments without a written contract that says this is a settlement offer.

Im concerned here that when Navisite gets bought up by a new company that they wont offer such a good deal.

Navisite is probably going under. Or someone will buy em. If it goes under great. But if someone buys em they may have more firepower to harass me.

Im pretty proud of myself. This was my goal and I got it.

But now Im second guessing.

It was just way too easy ya know..

If this was poker it would be a great tell. That they have no leg to stand on. They just let me work em and work em any which way I wanted.

Does the contract state that you have to pay an exit penalty for leaving? Hell, they allowed you to sign a contract under the wrong company and name, then all these posts are super stupid..


Tell them to sue you and drop this crap. You can tell them to stop calling, and they must stop calling. You can tell them to put up or shut up, harassment is illegal. Even more so when they are basically blackballing you into paying.

The Boneprone I know would have told them to go get bent... If I put a vice on your balls can I get paid... $9k?

that's what I mean, if they seen this thread they would have evidence of you admitting you actually did sign the contract with a different name.

I'm no lawyer (obviously) but I know they always tell you never to discuss a case publicly. I wouldn't want anything I said on a forum to come back and bite me in the ass in case I decided not to pay and it did go to court.

If you take this current situation to an attorney and show him that you signed the contract with a different name and the company on the contract doesn't even exist (they didn't ask for your fictitious business name statement so they could check you out in Lexus Nexus?) and your attorney might tell them to go fuck themselves and here is why and their own attorney might agree it is pointless...

And then you pay your guy $500...

From what I read they put you into an auto renewing contract without telling you? Any hosting company I've even been to has always told me when my one year was up and that I am free to leave without penalty. I can sign a new deal and try negotiate less money per month, but never have I had a deal like you seemed to be in.

is that true? I would check with an attorney on whether you could invite bigger problems if it is claimed that you misrepresented your identity for fraudulent purposes. I would be careful about that. It is probably wiser to consider the contract as being legitimately signed regardless of what company name you put on it, and work from other strategies than that one. just a non-legal opinion from me though, I could be way wrong

Paid every month on time. Paid 100% up till the day I left with notice. I left, paid all dues and they closed my servers and I moved on.

5 months later they come knocking saying they want 9k. I ask for what. They say becasue I left early.

The contract was auto renewing every year. On the month of October to be exact. I left on November. Paid up till then. 5 months later after ive been gone they say oh by the way you left early and you still need to pay us for the year.
One thing you didn't mention is that you were paying 5x the price for the last couple years...

I think so far you did a great job holding them off, and I applaud you for the way you handled it. I'm sure there are people on GFY who find it all retarded and would rather get fucked in the ass, but not me. They lost a lot of (potential) business with this snake move. I know for a fact I would never trust my sites with scumbags like that.

I'd probably not pay and watch them for their next move, as they haven't been able to get anything done so far. One would think that if they had any ammo they'd just take the full amount instead of negotiating. Also $3k is still a ripoff considering you've been a long time well paying client. They don't deserve a fucking cent.
