I see people using those myspace, facebook, girlfriend, self shot pictures everywhere, and i'm wondering if they actually own the rights to use them or whether they are just using them.

I mean a lot of this stuff has to be stolen, there is just no way.

They steal what they like and use it without problems because the copyright holders are typically individuals instead of companies and are thus unlikely to find out and sue.

Still, it's most definitely copyright infringement.

Do you think that if there was the case of a proper lawsuit against a big site by one of the affected individuals, could this set a precedent so that such sites would go down easily?

Because I've seen people I know on such sites, they're not in the industry, and I'm not in touch with them... but it's a possibility

No different then the majority of stuff on the internet, once its out its out, people throw it up anywhere and everywhere. The paysites I know with this stuff is legit though I know

The ones that crack me up are the photos of a few girls together, like a group self shot at a party or something and the site photoshops a huge facial on all of them.

so you're saying that you can take a photo of anyone and use it whatever way you please?

This may be the case in self shot pictures, but if there is more than one girl involved, the person publishing them could get in trouble if the other person (or people) in the photo doesn't agree with the form of use.

Basically, the original photographer has the right to publish/use a photo IF he has a signed model release form.
