Actually there isn't. Legally we can hold him withour any kind of a trial until the war on "terror" is won and that will be when hell freezes over.

Um you are aware Obama already declared the war on terror over. He agreed with most people with a brain and figured out we can not have a war on a tactic.

We as a country are also supposed to be better than that. We used to take the moral high ground. I am beyond glad that they are getting a trial. I also do feel that the numerous water boarding incidents should be allowed into the trial.

I put "terror" in quotes and I also put "terrorist" in quotes...and always try to remember to remember to do so as I do not like the terminology and I do not think it is applicable. In every war POW's are held for the duration of the war. We have an enemy and we declared war on that enemy and although he has been declared to be an "enemy combatant" he is techically a POW and can and should be held until the "enemy combatants" are defeated and that will be when hell freezes over.

BTW...believe what you like...as I personally do not give a damn...sport.

Here is the potential problem with that. Do we really know who the combatants are? Sure we can say Al Qaede and in some cases we can prove it, but when will we know we have all of Al Qaude taken down? We will never have them all taken out so we could hold these people forever. If we are fighting another country, we can easily identify the combatants and we can have cealr cut conditions of victory. When we grab these guys and hold them forever without a trial all it does is fuel the hatred towards us. At least this is step in the direction of clearing up why we are holding these guys.

Most wars are military type encounters. This war against terrorism is one part military fight and one part political fight and one part morality conflict. We can't just grab people, hold them forever and expect to win the moral part of the war, we have to prove to the world that we are right and just and the good guys.

I really do not have a problem with giving them a trial although legally we do not have to but it should be by Military Tribunal and never should they be tried in our civilian courts. Civilian courts should be for criminals and not "enemy combatants". Enemy combatants are in essence soldiers and should be treated and tried as such.
